Terms and Conditions

The Contract between the Israeli Defense Exports and the Customer is formed when a Sales Order is sent and payment will be expected immediately or by the end of the next month, depending on the payment agreement agreed upon by both IDE and the Customer. Until the full payment of the equipment is transferred to the Israeli Defense Exports, all equipment given to the Customer is still property of the IDE and are considered to be leased, still open to being recovered if payment fails or if the Contract falls through. Customers may request a cancellation of the Sales Order only in the case that the equipment has not yet been delivered. Once the equipment has been received the Sales Order is considered final and no refund may be filed. If the equipment is damaged in any way during delivery then evidence will be required. If IDE considers the evidence sufficient then the Sales Order will be re-built, once the damaged equipment has been returned to IDE. Products sold by the Israeli Defense Exports cannot be resold, upgraded, reverse engineered, exchanged, or dismantled without authorization by either IDE or the Israeli government. Before a Sales Order is accepted the Terms and Conditions must be accepted by the Customer.

It has been brought to our attention that Israeli Defence Exports, currently publicly advertise the sale of a number of military-grade products in the form of online advertisement by means of website and form design. The design in use is disputed by our clients as infringing on the copyright template and design bespoke to Sparrow Industries. I am duty-bound to inform you that Strömberg International Legal Consultants has collated a significant amount of evidence (including financial data and physical advertisement) that we intend to take to civil court should this cease and desist not be actioned immediately. Specifically we demand you cease use of your current website, and subsequent forms, template and design.

Following the serving of our previous cease and desist, which you have ignored, we will accept this as wilful infringement of our clients legal rights. You will now cease all trading activity with the aforementioned material. If you fail to comply with the demand, Sparrow Industries and Förbindelse Marketing Solutions are entitled to use your failure to comply as evidence to seek monetary damages and equitable relief for your actions via the judicial system. If in the event that you fail to communicate with us, please be advised that our clients have asked us to make it clear to you that they will be looking to pursue all available legal remedies and should we be forced to go via the judicial system they will be requesting court costs, counsel fees and other appropriate expenses. Your liability and exposure under such legal action could be considerable and will likely result in a monetary loss which we will pursue. We will be acting on behalf of our client and any further correspondence will be official, on behalf of our client and the judicial system of our choosing.

Before taking legal action, however, my client wishes to give you one final opportunity to discontinue your illegal conduct by following the instruction given within this letter.

You will receive no further correspondence, failure to comply with this letter will result in further action.

As it had now been over twenty-four hours, usually by now the letter would have reached its destination. However, once again, the letter had no address to be sent to, those within the Israel Post Company would not know where to send it to and therefore the letter would become lost, tossed aside into a bin with all the other letters that have not been given a receiving address.

The Israeli Defense Exports leaders would not receive the letter and would be none the wiser of Stromberg's attempts at contacting them.
