Message to Nexus Group

To: Amy Templeton, Nexus Group
From: Minister Joseph Watson, Department of Finance
CC: Minister Emily Gale, Department of Justice

Hello again, Ms. Templeton,

If you recall, you spoke with my government and a Mr. Gerald Bull, the Minister of the Department of National Defence, regarding payments of M2A2 Bradley infantry fighting vehicles that were 'missed' by Canada's previous government for 'delivered' equipment. As Canada was undergoing internal discord, we did not take the time to look into it and thus paid your company the money that you told us Canada supposedly owed you. However, this discord has come to an end and both my department and the Department of Justice has begun looking into all the transfers and productions of the previous government and it has come to our attention that we never owed your company any money...

As per the following: Transfer One, Transfer Two, and Transfer Three. Transfer one and two were accepted and in turn production one and two of the ordered M2A2 Bradley infantry fighting vehicles batches were produced - 180 in total. However transfer three was not accepted and a fourth transfer of payments was never made. This means that the other 180 M2A2 Bradleys were never produced and never sent to the Canadian Armed Forces and thus you had us pay for products which we did not receive. For reference, these are the only products from Nexus that were ever delivered to Canada: M2A2 Batch 1/4 and M2A2 Batch 2/4.

Before asked or recommended: no, we do not wish to receive the other two batches of the M2A2 Bradleys. As you had us send money for products we never received, we are demanding that Nexus Group refunds this money immediately. We are willing to forgive this situation if Nexus sends us back the money as soon as possible under the belief that our people simply made mistakes and none of this was intentional. However, if Nexus Group does not send us the money back within the allocated timeframe, we will have no choice but to assume that your company intentionally manipulated Canada in a dire and hectic time to elicit money from the our government and begin legal action through the International Court of Justice. Consider this chase 1/2 to request immediate repayment, we will be updating this email within a week's time if no update has been made.

As per this transfer, Nexus currently owes the Canadian government: 969,365,880.00$

Kindest Regards,
Joseph Watson
Minister of Finance
Kingdom of Canada

Good Afternoon,

Here at Nexus we do our utmost best to retain professional, sell high quality goods and maintain good service; there are always room
for improvements and we aim to work with our partners to accomplish that. However, unfounded allegations and demands, with no
prior discussion to resolve any issues; is unproductive. Which brings our own internal investigation forward.

We can confirm full delivery of the order, and find the unusual timing to be suspicious; and random. Rather than intending to discuss
and resolve, you seem to have been extremely quick to threaten legal action; which we will be happy to attend with our Legal Team.

I can confirm that all shipments were made and tracked. However, due to the unusual nature of your demands, for us to review this
further and potentially offer further refund. We would require an Inventory of your Armed Forces M2A2 Bradley Infantry
Fighting Vehicle assortment for the last twelve (12) months.

If you could please authorize access to review your inventory, we will be able to confirm this is the case and respond
appropriately.

As I am sure you can respect, it is difficult to judge this situation with half of the information which has come across as nothing
more than a unfound threat. For your convenience, I have attached the two additional despatch notes to confirm the delivery.

Kind Regards,
Amy Templeton,

Two despatch notes were attached with the same dates as the original deliveries of batches 3 and 4 were meant to have left the factory.

Hello Templeton,

There are no threats, Miss Templeton, I am simply reflecting the tone of which your elicit messages regarding payment of undelivered and unmanufactured products generated. Should I remind you that you also threatened legal action?

All information regarding the shipments of M2A2 Bradley infantry fighting vehicles shipped to Canada have been provided to you via my first email. As stated with this information, two batches are missing - the batches which you stated we did not pay for. However, as stated, upon further investigation, we discovered that these batches never existed to begin with. If you believe this to be incorrect then you may check your own inventory of manufacturing, shipping, and purchases. I am certain that a business as large as yours assures that all information is kept up-to date and you will see that this information matches the information which I have sent to you.

Furthermore, I am unsure of what you have attached to this email. Are these notes supposed to be your attempts at confirming the delivery? These aren't even in the proper format! Lastly, Canadian Forces Base Longue-Pointe, the center point of all the Canadian military imports has no evidence of this delivery. Regarding your requirement to review Canada's inventory of M2A2 Bradleys, we have already done this via the deliveries we attached to our first email. However, for the sake of a healthy process, I have attached the official documentation of the inventory of M2A2 Bradleys within Canadian service. Bear in mind that, due to national security, the location of these vehicles have been redacted but the numbers remain accurate.

Kindest Regards,
Joseph Watson

Good Afternoon,

Thank you for providing an attached inventory, however, this report is an invalid piece of evidence as can be modified to justify
otherwise. Please can you grant us authorization to review the full inventory of the M2A2 Bradley IFV.

Hello Templeton,

I am uncertain what more you would want as documentation for full inventory of the M2A2 Bradley... This is the official inventory made by the Department of National Defence. These numbers are accurate. Only the locations have been redacted - not that you need the locations to confirm the numbers and the deliveries.

We are not granting your company access to our national stockpile so that you may confirm a singular number and product which we have already provided to you - twice. All I can assume from your current stance is that you are attempting to deter Canada from pursuing a refund by attempting to be granted information that is not relevant to the refund process nor that can be granted due to national security. If that is the case then we will have no choice but to escalate this demand and get our legal teams involved in this process and move this to the International Court of Justice which would in turn make this situation public.

We do not wish to do this but if you refuse to accept the perfectly legal, accurate, and proper documentation that you have been granted then we will have no choice but to do so.

Joseph Watson

Good Afternoon,

If you are unable to provide access to the National Stockpile for the M2A2 Bradleys, then we are happy to wait to hear from the
International Court of Justice who will, of course, require access to the same stockpile to confirm the quantity that you have.

If the quantity is correct, then providing us with access to review the M2A2 Bradley Stockpile would remove the need for legal
involvement and resolve the issue internally. Which, I am curious as to why that would be an issue given we sold them to you
which means it would not impose any risk to national security as we would only need access to that specific information; unless
something is been concealed.

We will wait to hear from either the ICJ or authorisation from yourself to conduct our own review of the quantity of IFVs that
we had sold to you.

Kind Regards,
Amy Templeton,

Hello Templeton,

We have given you access to the national stockpile of the M2A2 Bradleys, your refusal to read it is a problem only for yourself and Nexus.

There is nothing being concealed, as per the documentation that I have sent you. Additionally, we are far more comfortable in having the Justices of the ICJ access Canada's national stockpile of vehicles and weapons than individuals from a corporation.

With that said, as you are refusing our evidence I ask that you send your own to verify to us that the M2A2 Bradleys were in fact manufactured and sent to Canada. Since you are saying the fault is Canada's, this evidence shouldn't be difficult to send, will it?

Joseph Watson

Good Afternoon,

Providing documents that consists of a product name, and a quantity, do not contribute to access to review the Stockpile. We are not
interested in been given access to all vehicles and weapons; just the M2A2 Bradley which can be filtered out. Nonetheless, like you,
we will wait to offer the despatch notes to the ICJ as that is the path you wish to take.

If you wish to grant us access to the Stockpile for the M2A2 Bradleys to review, in return, we will send the confirmation for the
productions invoicing, we would be able to resolve this between your government and ourselves. However, as this is not something
you wish to do, there is no further need to converse as it can be handled by the Justices of the ICJ.

Many thanks,

Amy Templeton,

In preparation for a call to the International Court of Justice, the email chain between Nexus Group and the Canadian Government would be forwarded to Stromberg. This would be followed up with a call from Amy Templeton, both the email and call would be on private and secure lines as the company prepared to request a legal team to support their presence. It was raising concerns that authorization to the Stockpile would not be granted, indicating suspicious activity and a potential rouse to steal money. Therefore, the call would also give the chance to discuss forcing a hand in court to see the Canadian quantities of the vehicle to allow further investigation to take place within Nexus Group internally. Amy waited patiently on the phone hoping for an answer from a legal advisor within Stromberg.

The email chain sent to Strömberg International Legal Consultants would land in a generic inbox awaiting review by the relevant team however in the meantime, once the telephone call had been diverted through the relevant switchboard it would eventually make it to the desk of Regional Manager for Europe Einar Åkesson - responsible directly for the business and legal arrangements in Europe and for partners or business based in Europe. The call is naturally encrypted due to the organisation often dealing with matters of national security with several other high profile clients in both national government and military hardware trade sectors.

"Thank you for calling Strömberg ILC, Einar Åkesson speaking, how can I help?"

Confined to a private office, Amy responded. "Good Evening, thank you for speaking with us on short notice. As per the correspondence sent, there is a growing legal dispute between the Canadian Government and Nexus Group over the purchase of 360 M2A2 Bradley Infantry Fighting Vehicles in January 1997. This was on a financial plan for four payments which two were received immediately, the second and third had a delay which resulted in us chasing them on two occasions for payment for us to invoice the full order after delivering the goods. They paid several months ago now and have since, u-turned and demanded the money back claiming not to have the products. Sounds a bit mad, when saying it out loud. It's not like Bradley Vehicles can be there and they pay for them, then suddenly they're gone.

We would like to know whether Stromberg would be able to represent Nexus Group in the International Court of Justice to make our case. Our request to see the Stockpile of their M2A2 Bradley's to confirm that they don't possess more than their claimed amount of 180 -- they refused and then they are raising it with the ICJ. I find this suspicious but I am sure this is something the court would be able to receive, otherwise we would be seeking to have Canada cover legal costs and reputation damage which has already taken place in the form of Twitter and other Social Media activity. We have the despatch notes for the vehicles which were sent, if the Canadian Government doesn't have the vehicles, then it will be an investigate further internally as I have already conversed with them. However, they only seem to see what they want too at this point.

However, in further thought, if there is any concern from the court as to the delivering of Bradley's which is all we want to see - is evidence behind it to ensure we are not making a substantial loss for nothing - then rather than a refund, we will ensure another batch is delivered. This is in line with our Terms and Conditions policy that the Canadian Government signed. To provide you with further information on top of their emails, please find the other information from ourselves:

Terms and Conditions - As some if not all products have been delivered, the right to cancel the order is revoked. Additionally, the clause which confirms any issues: If the goods are damaged or not received, if evidence is provided then Nexus will re-send the package.

Due to repeated late payments, the Canadian Governments credit score is the lowest end of the spectrum. This also relates to the stability of the country as over the last few years, since the order was placed, the country has seen multiple collapses. This is also potentially something that would back our case in court as if they have managed to misplace Bradleys', it would not be a surprise given the amount of governments that are in and out. Of course, providing there isn't evidence to suggest they had more than their claimed quantity of 160.

If upon seeing the evidence and that it's confirmed no deliveries were made, we will stick to our obligations and deliver another singular batch for the outstanding amount. Our issue as it stands is that our documentation suggests it has been delivered and received, and the government refuses to allow us to review the stockpile for the M2A2 Bradley. Which I will also add, shouldn't be a threat to national security as we delivered those vehicles so are aware of how many they have and all their technical specifications.

Due to the way they have bypassed our existing requests to review it, I have no doubt they will continue to refuse to do so. Even to the ICJ.

Hopefully you may be able to assist here?"

"Ah yes, Ms Templeton, I was forwarded your email shortly before your telephone call. I have to be honest I haven't had chance to read through it all in much detail although I have heard in the grapevine that the Government of Canada has skipped the ability for an out-of-court disposal and already filed a case with the International Court of Justice. This is certainly a case we'd be able to pick up for you, costs of which would be recovered via the courts through the defendant however if you were to lose the case these costs would be retrieved via Nexus Group.

You have a good case if what you've told me is correct but I need to have time to collate the evidence, read through documentation and have my team examine the filing to the court. We have the upper hand as the 'defendant' in this case as I have the chance to request a continuance from the court in order to allow the team to examine the evidence and begin the collation of witnesses and documentation to support our defence. There's a lot to go over and it will require your support extensively - including access to delivery notes, stock levels, invoicing and bank transfers exclusively relating to the Canadian purchases of the M2A2 Bradley.

I suppose before we discuss the case in too much detail I should start with the basics. If you're going to seek our consultancy you should cease all contact with the Canadian Government regarding this matter and permit us to act on your behalf in the interests of your organisation - this will include us contacting them ourselves to seek out-of-court disposal. Their filing with the courts is not the be all and end all. Avoiding the ICJ is in your interests, it's expensive, it's uncertain, it's stressful and it's long.

If our own peaceful settlement fails, we will request a continuance from the court and begin building your case for presentation to the court, as I mentioned before."

"Costs are not of concern, if the case wins, we will, in good faith; double the amount Stromberg will receive. If the unfortunate happens and the case is lost, we will cover the costs for your services. We will cease communication with the Canadian Government and do authorize you to act on our behalf. Additionally, you have authorization to review all of our accounts information. To verify, the order you would require is Sales Order 016. In the meantime, is there anything else you require from us to begin your investigation and attendance to the International Court of Justice?"
