Argentine Federal Courts Republic of Argentina v. Barbro Elm et al.​

Criminal lawsuit against former swedish ambassador to Argentina, Mr. Barbro Elm, and other swedish personnel formerly working for the swedish embassy in Buenos Aires, for the charges of espionage, under Federal Law 13.985. The trials will be of public nature and the accused would be given the opportunity to present their own defendant. If not, a public defender will be apointed for them. If found guilty, the mentioned law establishes life imprisonment for agents found serving the interests of a foreign state. However, extradiction could eventually also be considered after a sentence has been made.

After the latest developments and information, the Argentine Federal Justice decided to restructure the case, ordering the immediate deportation of the swedish detainees and lifting all accusations, while also puting in a 10 year travel ban.

The 44 detainees would be flown to Australia, as arranged with the australian authorities on a AAF Boeing 767-300ER, making the necesary technical stopover to refuel, on the most direct and safe route.

With the Argentine Air Force jet approaching Australian airspace it would be monitored, first on the JORN through No. 1 Radar Surveillance Unit and then through Northern Region Operations Centre series of civilian and military radars. Upon approach over Perth and into RAAF Base Pearce the ATC will begin communicating with them. The passengers would see the beautiful Perth skyline out of their aircraft.

"Argentine 767, you are cleared to approach Pearce from the south, landing Runway 36R."

After it goes through the approach maneuvers it would be given clearance to land.

"Argentine 767 you are cleared to land, Runway 36R."

Once it landed it would be given taxi instructions.

"Argentine 767, taxi to Air Movements Terminal."

On the ground a stairwell would be ready to attach to the aircraft. Cones will be on the tarmac to guide the Swedes into the terminal. RAAF Police would be standing around keeping guard. Australian Quarantine and Inspection Service members would board the aircraft and spray a non-harmful bug spray throughout the cabin.

Immediately, the Swedish would notice the scorching Perth heat because it was Summer, the middle of Summer to be exact. Currently in Perth it was 38 degrees. Out at RAAF Base Pearce which was in Bullsbrook outside of Perth it would be a little warmer, 40 degrees. There was no cloud cover, just sunshine.

Once inside the terminal they would begin being processed by Australian Customs and Border Protection Service officers. They would be immediately hit with the 23 degrees inside the terminal thanks to powerful air conditioning. They will check passports, ask questions such as "Do you have tuberculosis?" "Are you carrying any fruits, vegetables, animals, plant matter, soil, wood or any organic matter?" "Are you carrying any prescription drugs?" "Are you carrying any illicit drugs?" This was done more rigorously as their requirement to fill in incoming passenger cards was waivered by the Minister. They were all given Special Category Visas, which essentially means they are exempt from a Visa and are in Australia at the pleasure of the Minister for Immigration as per the Migration Act 1958.

Once all cleared and through the terminal they would be ushered onto buses. These buses would be escorted by the Western Australia Police FORCE. They would be taken out of the air base and towards Perth metropolitan area to the Immigration Detention Centre. They would be taken along National Highway 95/National Route 1, Great Northern Highway and then onto National Highway 94/State Highway 3, Roe Highway and then Great Eastern Highway Bypass. One of the buses would have a busted air conditioner and it would quickly turn to an oven in there.

Once arriving at the Perth Immigration Detention Centre they would be taken inside and set up, placed into individual dormitories. They would be sharing the facility with a range of foreign nationals who illegally entered Australia, particularly from Asia, the Middle East and Africa.

Once all detainees were transfered to the australian authorities, the military police that was accompanying the swedish in the flight would board again, while the flight crew would be switched for a new one that was waiting on the front seats of the aircraft. All this was done while refueling was requested and done, preparing for the return flight.

With everything ready, they would return on the same route back to Argentina and notify of the succesful delivery.

The Swedish would be formally notified that their nationals would now be in the custody of the Australian Customs and Border Protection Service (Connor).

Once they were settled in their rooms, they would be given thorough health assessments by WA Department of Health staff and nurses, mainly from the Royal Perth Hospital. They would be given both physical checks and mental checks. Indeed, the nurses were quite the eye candy.

Most individuals would come back fine, some had some level of generalised anxiety and depression and were going to be looked after by a psychologist and prescribed anti-depressants if need be. Most were to some level, malnourished and catering staff at the facility would make sure that a nourishing and balanced diet was given to the detainees.

Court Order for the Minister for Immigration and Ethnic Affairs​

"Dear Senator Ray, It has been brought to the court's attention about the detention of 44 Swedish nationals at the Perth Immigration Detention Centre. The court has deemed this detention illegal and in violation of the Migration Act of 1948. The act does not provide for foreign nationals to be detained indefinitely on Australian soil and requires them to be deported immediately to their home country if there is a will to be deported. From my understanding and my visits to the centre, all 44 nationals are willing to return to Sweden and the Commonwealth is required to comply to allow them to leave Australia. We agree that these individuals are "aliens" for the purpose of Section 51(xvii) of the Constitution and that the Parliament, not the Executive, is allowed to make legal provisions for these individuals but the legal provisions which have been created by the Migration Act of 1948 does not allow for indefinite detention when there is a clear will to leave Australia. Any changes to this law would require the passage of both houses of Parliament and Royal Assent as per the constitutional process, something which has not been done. We also understand that an informal verbal agreement was made with the Government of Argentina regarding these individuals and that the Commonwealth is allowed to do this under Section 51(xxix) of the Constitution but that it requires legislative approval in order to be implemented in Australia, something which was also not done. Therefore the court finds the Commonwealth in violation of the law and requires them to immediately make provisions for the departure of these 44 individuals from Australia back to Sweden within 24 hours of this notice. The letter would arrive on the Minister's desk.

"Ah fuck..." He would ring the Immigration Detention Centre and request that all 44 nationals be released under police escort to Perth International Airport. From there they would be required to board flights to either Hong Kong, Singapore, Kuala Lumpur or Bangkok and to find connections onwards to Sweden.

The Minister for Foreign Affairs would give notice to the Argentine Government that a court ordered injunction has prevented them from continuing to detain the Swedish nationals and that they will be returning to Sweden.

All 44 nationals, upon arriving at Perth International Airport, would make the relevant travel arrangements via Singapore and the Netherlands to eventually arrive in Stockholm. Each and every person would receive full reimbursement for any costs incurred as a result of the travel and the Executive Office of the Prime Minister of Sweden would be informed of their release, especially with this crisis being at the forefront of Swedish political agenda - upon arriving in Stockholm they'd immediate be greeted by their families whom were informed by the Department of Justice, being the department responsible for their release. All of those arriving would be offered the appropriate level of mental health support, medical assessment, inoculation and vaccination as standard procedure.

No message was sent to the Australian authorities, other than confirmation of their safe arrival in Sweden.

The Argentine Republic would not object the deportation from Australia to Sweden, since the Federal Justice redirected the blame of the issue to the swedish government as an entity instead of the individuals detained in Buenos Aires.
