Overview

The Australian Maritime Safety Authority (AMSA) is an Australian statutory authority established in 1990 under the Australian Maritime Safety Authority Act 1990 and governed by the Commonwealth Authorities and Companies Act 1997. It is responsible for the regulation and safety oversight of Australia's shipping fleet and management of Australia's international maritime obligations. AMSA is funded largely through levies on the shipping industry. The authority has a jurisdiction over Australia's exclusive economic zone which covers an area of 11,000,000 square kilometres. AMSA maintains Australia’s shipping registries: the general and the international shipping registers. Marine safety activities of AMSA include:

  • The provision, operation and maintenance of a network of marine aids to navigation, for example, lighthouses;
  • Ensuring the seaworthiness and safe operation of Australian and foreign vessels in Australian waters, including the enforcement of compulsory pilotage;
  • Administering the certification of seafarers;
  • The provision of a maritime distress and safety communications network;
  • The operation of Australia's Rescue Coordination Centre and coordination of search and rescue (SAR) operations for civilian aircraft and vessels in distress; and
  • The development of a maritime safety commercial vessel legislative framework and operating system.

Overview

The Civil Aviation Safety Authority (CASA) is a government body that regulates Australian aviation safety and the operation of Australian aircraft overseas. We employ about 800 people working across Australia to keep our skies safe for all. We license pilots, register aircraft, oversee aviation safety and promote safety awareness. We are also responsible for making sure that Australian airspace is administered and used safely. We were established in July 1995 as an independent statutory authority. We operate within a legislative framework made up of acts, regulations, associated legislative instruments and guidance material. Our role is described in the Civil Aviation Act 1988, which also forms the basis of the Civil Aviation Safety Regulations. These regulations are broken into parts, which may have an associated Manual of Standards, as well as supporting guidance materials. Together with the Department of Infrastructure and Transport, and Airservices Australia, we constitute a tripartite structure for providing safe aviation in Australia. The current Director of Aviation Safety is Shane Carmody.

Foreign Operators

In accordance with Section 26(1) of the Civil Aviation Act (1988), an aircraft arriving in Australian territory from a place outside Australian territory or; departing from Australian territory for a place outside Australian territory must not do so except with the permission of CASA.

Carrier's Liability Insurance:
Operators intending to carry passengers for reward or hire into, from or within Australian territory need to comply with the requirements of the Civil Aviation (Carrier's Liability) Act 1959. The Act requires carriers to hold insurance to ensure compensation will be paid in respect of death or personal injury suffered by passengers on aircraft.

Third Party Liability Insurance:
Under the Damage by Aircraft Act 1999, Australian law provides for strict and unlimited liability for compensating third parties on the ground suffering death, injury or damage from aircraft within the Commonwealth's jurisdiction. It is a commercial decision of airlines to decide what insurance cover should be held. The Australian Government will assess whether the cover is appropriate for the level of an airline's operations in Australian territory.

Injury and loss as a result of active hostilities or civil unrest (War risk insurance):
The amount of war risk insurance covering passengers, hull and third party damage on the ground is a commercial matter for the airline. The Australian Government will assess whether the cover is appropriate for the level of an airline's operations in Australian territory.

Additional Landing Permission:
Although a permission granted by CASA may allow an operator to land at specified airports, permission must also be obtained from the relevant airport authority (the aerodrome operator) for the use of movement areas, aprons and terminals of both destination and alternate aerodromes. Time slot clearances must also be obtained. This is particularly important for operations into Sydney (Kingsford Smith) International Airport, where a legislated slot scheme is in place. Time slot clearances can be obtained from Airport Coordination Australia.

Border Control:
Operators intending to operate a charter service to an airport other than Adelaide, Brisbane, Cairns, Darwin, Melbourne, Perth or Sydney, may need approval from Customs, Immigration, Health and Quarantine authorities. Please note that in most instances, operators are required to provide four weeks written notice. For further information contact the National Passenger Processing Committee.

Non-Scheduled Flight Permission:
As determined by the Civil Aviation Act (1988), a non-scheduled flight means a flight over or into Australian territory otherwise than under the authority of an International Airline Licence (IAL). In accordance with Section 25 of the Act, a foreign registered aircraft possessing the nationality of a Contracting State conducting a non-scheduled flight into Australian territory must not take on or discharge passengers, cargo or mail in Australian territory for reward except with the permission of CASA and in accordance with any conditions specified in the permission. Similarly, a foreign registered aircraft not possessing the nationality of a Contracting State shall not make a non-scheduled flight over or into Australian territory except with the permission of CASA and in accordance with the conditions specified in the permission. CASA will not consider a proposed operation unless first approved by the operator’s own State of Registry. Operators wishing to conduct more than eight non-scheduled flights in one 12 month period may be required by CASA to obtain a Foreign Aircraft Air Operator’s Certificate.

Noise Regulations:
There are Regulations affecting the operation of large marginally compliant (MCC3) jet aircraft in Australia. Non-scheduled operations by MCC3 aircraft are prohibited at: Sydney, Melbourne, Brisbane, Perth, Adelaide, Hobart, Canberra, Darwin, Gold Coast, Newcastle (Williamtown), Essendon and Avalon airports. Applications for Non-Scheduled flights to these ports can only be assessed if a noise permission has been obtained from the Department of Infrastructure and Transport.


International Airline Licence

Any airline proposing to operate scheduled international air services over, into or out of Australian territory requires an International Airline Licence (IAL) before it can commence services. This includes cargo only operations. Airlines proposing to market seats and/or cargo capacity to and from Australia under code share arrangements with another airline also require an IAL. In these circumstances, an approved applicant will receive a limited licence which only authorises code sharing, provided that the services conducted on behalf of the applicant are operated in accordance with Civil Aviation Safety Authority and Office of Transport Security regulations. If the marketing airline in a code share arrangement wishes to commence operations with its own aircraft in the future, it will need to reapply for a full IAL.

Airline applicants proposing to use wet or damp-leased aircraft to conduct scheduled international air services must provide the department with the following information:

  • A declaration that they intend to use wet or damp-leased aircraft to conduct proposed services;
  • Details of the provider of the aircraft for the proposed services; and
  • Evidence that the wet-leased aircraft is compliant with Civil Aviation Safety Authority and Office of Transport Security regulations for the proposed services.
Foreign airline applicants must demonstrate that they are designated by their country. This can be evidenced by submitting a copy of a relevant Third Party Note or where this cannot be located, by providing a declaration that the airline is appropriately designated, signed by a Senior Airline Official. Foreign airlines must also demonstrate that they meet the requirements of their country relating to incorporation as well as ownership and control and/or principal place of business and/or incorporation.

Applicants are required to supply a copy of an insurance contract or certificate from an insurer evidencing that appropriate insurance is held by the applicant in relation to the following:
  • Passenger liability (Carrier's Liability Insurance);
  • Third party liability;
  • Cargo and baggage liability; and
  • Injury and loss as a result of active hostilities or civil unrest (War risk insurance).
Applicants are required to prove they are compliant with Office of Transport Security regulations for the proposed services. Regulations by the Office of Transport Security within the Department of Home Affairs are in accordance with the Aviation Transport Security Act 2004 and related regulations.

Before air services may commence, and in conjunction with the issue of an International Airline Licence, applicants are required to separately submit details of proposed timetables to the department. Timetable details should include the type of aircraft to be used for each scheduled international air service in accordance with regulations 14 and 29 of the Air Navigation Regulation.

Office of Airspace Regulation

The Office of Airspace Regulation (OAR) exercises powers under the Airspace Regulations (2007) to regulate and administer Australian airspace, including prohibited, restricted and danger areas, where certain types of activities take place that may present a risk to aviation activities. Australian airspace administration has airspace classes and associated air traffic services Airservices Australia and the Department of Defence provide those air traffic services. Private Pilot License

In order to gain a Private Pilot License (PPL), the minimum requirements are:

  • Obtain a mark of 70% or more in the CASA aeroplane or helicopter exam, which tests all seven subjects listed in the Day VFR Syllabus.
  • Hold a class 2 or greater medical.
  • Have a total of 40 hours total flight time, of which 10 must be pilot in command, which must consist of a minimum of 5 hours cross country solo, and a 2 hours instrument flying must also be required before being eligible to hold a PPL.

Overview

The Australian Transport Safety Bureau (ATSB) is an independent Commonwealth Government statutory Agency. The ATSB is governed by a Commission and is entirely separate from transport regulators, policy makers and service providers. The ATSB's function is to improve safety and public confidence in the aviation, marine and rail modes of transport through excellence in:

  • Independent investigation of transport accidents and other safety occurrences;
  • Safety data recording, analysis and research; and
  • Fostering safety awareness, knowledge and action.
The ATSB is established by the Transport Safety Investigation Act 2003 (TSI Act) and conducts its investigations in accordance with the provisions of the Act. Under the TSI Act, it is not a function of the ATSB to apportion blame or provide a means for determining liability. The ATSB does not investigate for the purpose of taking administrative, regulatory or criminal action. The Bureau's Commission is constituted by a full-time Commissioner and three part-time Commissioners. The ATSB's staff (approximately 100) includes about 60 aviation, marine and rail safety investigators. Most are based in Canberra. Field offices are located in Brisbane, Adelaide and Perth.


Responsibilities


Aviation

The ATSB is responsible for the independent investigation of accidents and incidents involving civil aircraft in Australia. The ATSB's primary focus is the safety of the travelling public. However, all accidents and incidents related to flight safety in Australia or involving Australian registered aircraft overseas must be reported to the ATSB. While the ATSB does not investigate all of these, it still needs to be notified so that the data can be recorded for possible future safety research and analysis.

Marine

The ATSB conducts marine investigations into accidents and serious incidents involving Australian registered ships anywhere in the world, foreign flag ships within Australian waters, or where evidence relating to an accident involving ships is found in Australia. Accidents and serious incidents must be reported as soon as practicable to the ATSB. Often such a report will be made through the Australian Maritime Safety Authority (AMSA).

Rail

For many years, Australia has maintained a diversified approach to rail safety oversight. States have operated independent regulatory and investigatory arrangements resulting in differing rulesets and guidelines. However, the Council of Australian Governments have committed to reforms that have seen the establishment of a single national regulatory and investigatory structure, with the ATSB filling the latter role. Category A (significant) rail safety occurrences must be reported to the ATSB as soon as is practicable, with a follow-up written report supplied to the Office of the National Rail Safety Regulator (ONRSR) within 72 hours. Investigations may be commenced directly by ATSB staff from our Perth, Adelaide or Canberra offices. Category B (mostly less serious) occurrences are reportable directly to the ONRSR.



Overview

The Australian Rail Track Corporation (ARTC) was created after the Australian and State governments agreed in 1997 to the formation of a 'one stop' shop for all operators seeking access to the National interstate rail network. ARTC currently has responsibility for the management of 8,500 kilometres of track, mainly in South Australia, Victoria and Western Australia. ARTC is responsible for:

  • Selling access to train operators
  • The development of new business
  • Capital investment in the network
  • Managing train operations
  • Maintaining the network.
Today, our network services all the major capitals, markets, regional freight centres and import/export ports in Australia. Freight owners can now take full advantage of the new rail infrastructure, as well as new locomotives and advanced wagon designs, making rail a better freight alternative for business. While heavier goods moved in large quantities is a natural fit to rail with its ability to carry heavy tonnages in a single journey, there are many other opportunities for business, be it fast moving consumer products, bulk goods, regional freight or an import/export task.

Overview

The Australian National Line (ANL) is an Australian Government owned overseas and coastal shipping line. The Australian National Line was formed on 1 October 1956 as the Australian Coastal Shipping Commission with the passing of the Australian Coastal Shipping Commission Act. The organisation took around forty ships previously operated by the Australian Shipping Board, which had been formed in 1946 by the Federal Government. The ceasing of the ANL's involvement in the passenger trade has allowed them to concentrate solely on bulk freight and cargo. In line with government policy, ANL has a major focus on the environment for its vessels, containers and office operations.

Overview

Airservices Australia is Australia’s air navigation service provider. We exist to provide safe, secure, efficient, and environmentally-responsible air navigation and aviation rescue fire fighting services to the aviation industry. We are a government-owned organisation, formed in July 1995 when the Civil Aviation Authority was split into two separate government bodies: Airservices Australia and the Civil Aviation Safety Authority. We are responsible for Australia’s airspace management, aeronautical information, aviation communications, radio navigation aids, and aviation rescue fire fighting services. Every day of each year, we keep flying around Australia safe. It’s a huge responsibility and one we take very seriously. The agency maintains more than 4,000 skilled aviation professionals, including air traffic controllers, engineering specialists, technicians and support staff working from two major control centres, 29 air traffic control towers and fire fighting stations at 26 of Australia's busiest airports.


The Australian Advanced Air Traffic System

The Australian Advanced Air Traffic System (TAAATS), is the hardware and software system used by Airservices Australia for air traffic control services. It is a paperless, computer-based system, which serves as an aid to civilian air traffic controllers. It does not control aircraft, but gives the user a display of information about an aircraft's position and associated information. It also handles communications and other information exchanges. The Australian Advanced Air Traffic System, or TAAATS is one of two systems in Australia, the other being the Australian Defence Air Traffic System (ADATS), which is used by the military. TAAATS makes use of the Thales Eurocat system and is used in two FIRs, Melbourne and Brisbane. It is also used in Terminal Control Units (TCUs) in Adelaide, Perth and Sydney.

There are several facilities which use TAAATS in Australia. The two main area control centres in Brisbane and Melbourne both have roughly 42 operational consoles or "suites" and each suite has four computer screens:

  • Air Situation Display (ASD): This main screen displays a map of the sector that shows the location of all aircraft in the controller's airspace, as reported by one of several data sources – radar data processing, flight data processing and automatic dependent surveillance.
  • Aeronautical Reference Data Display & Distribution System (ARDDDS): A display providing access to a wide range of information including aircraft performance data, weather radar, airport/navigation aid/tracking point codes, airline ICAO designators, Standard Arrival Route (STAR) and Standard Instrument Departure (SID) charts and depiction of the airspace setup for TMA sectors.
  • Voice Switching and Communications Select (VSCS) panel: A touch-sensitive screen allows controllers to choose the radio frequency they need to talk to pilots and ground staff, or the intercom for talking with other controllers.
  • Auxiliary Display: The controller can call up a wide range of information such as weather forecasts, flight plans, strip windows, secondary maps and other material for the information of themselves and pilots.
There are two flight information regions (FIRs) separated by an approximately diagonal line running from the northwest near the border with Indonesia to the southeast near Sydney. There are two area control centres (ACCs), one in Brisbane and another in Melbourne each responsible for providing air traffic control services in their FIRs. The Brisbane Centre is responsible for the FIR northeast of the line, and the Melbourne Centre for the FIR southwest. In addition, Melbourne Centre is responsible for managing traffic handovers from South Africa, Mauritius, Sri Lanka, Maldives, Indonesia and New Zealand. Brisbane Centre manages traffic handovers from neighbouring flight information regions including East Timor, Papua New Guinea, Fiji and the United States. The TCUs in Adelaide, Brisbane, Cairns, Canberra, Melbourne, Perth and Sydney are responsible for providing air traffic control services in their Terminal Areas (TMAs).

Where the Royal Australian Air Force (RAAF) and civilian aircraft share an airport (Darwin, Townsville, Tindal and Williamtown), the RAAF takes precedence and provides the tower and approach services for that airport. Where an RAAF base is located close to a civilian tower with approach services, Airservices Australia provides the approach services for that base (Edinburgh and Richmond) from those towers. The RAAF only provides approach and tower services at their bases as all en route (centre) services are provided by Brisbane and Melbourne Centres.
