[RESOLUTION FOR LAW OF THE SEA]

The States Parties to this Convention,

PROMPTED by the desire to settle, in a spirit of mutual understanding and cooperation, all issues relating to the law of the sea and aware of the historic significance of this gathering as an important contribution to the maintenance of peace, justice and progress for all peoples of the world

CONSCIOUS that the problems of ocean space are closely interrelated and need to be considered as a whole

ACKNOWLEDGING the importance of safeguarding commercial maritime navigation to the economies of the nations


HAVE AGREED ON —


[CHAPTER 1, DEFINITIONS ]

(I) "Area" means the seabed and ocean floor and subsoil thereof, beyond the limits of national jurisdiction.

(II) "Activities in the area" means all activities of exploration for, and exploitation of, the resources of the Area.

(III) "Pollution of the marine environment" means the introduction by man, directly or indirectly, of substances or energy into the marine environment, including estuaries, which results or is likely to result in such deleterious effects as harm to living resources and marine life, hazards to human health, hindrance to marine activities, including fishing and other legitimate uses of the sea, impairment of quality for use of sea water and reduction of amenities.

(IIII) "Dumping" means —

(I) Any deliberate disposal of wastes or other matter from vessels, aircraft, platforms or other man-made structures at sea.
(II) Any deliberate disposal of vessels, aircraft, platforms or other man-made structures at sea.​

(V) "Dumping" does not include —

(I) The disposal of wastes or other matter incidental to, or derived from the normal operations of vessels, aircraft, platforms or other man-made structures at sea and their equipment, other than wastes or other matter transported by or to vessels, aircraft, platforms or other man-made structures at sea, operating for the purpose of disposal of such matter or derived from the treatment of such wastes or other matter on such vessels, aircraft, platforms or structures.

(II) placement of matter for a purpose other than the mere disposal thereof, provided that such placement is not contrary to the aims of this Convention.​

(VI) "States Parties" means States which have consented to be bound by this Convention and for which this Convention is in force.

[CHAPTER 2, LEGAL STATUS OF SPACES]

(I) The maritime areas are divided into zones known as Territorial Waters, Contiguous Zone, Economic Exclusive Zone and International Waters.

(II) Territorial Waters are the belt of coastal waters extending at most 12nm from the baseline, the mean low-water mark, of a coastal state.

(I) The territorial sea is the continuation of the sovereign territory of the coastal state, although foreign civilian vessels are permitted innocent passage through it.

(II) Right of Innocent Passage is allowed upon flying the flags of the Nation traversing the nation and the Nation which owns the waters, Nations may disallow a certain nation to pass by its waters, if it deems a danger to its national security. A Nation passing the waters, may only do so, via the quickest route and avoid, if being in a Military Fleet, Civilian Areas.

(III) The sovereignty of the coastal state extends to the airspace over and seabed below.​

(III) Contiguous Zone is the band of water extending from the outer limit of the territorial waters of a coastal state up to 24nm from the baseline.

(I) On the Contiguous Zone, the coastal state can exert limited control for the purpose of preventing or punishing infringement of its customs, fiscal, immigration or sanitary laws and regulations within its territory or territorial sea.​

(IIII) The Exclusive Economic Zone (EEZ) stretches from the baseline of the coastal state out to the 200nm boundary.

(I) The coastal state has special rights regarding the exploration and use of marine resources, such as energy production from water and wind.

(II) Military Forces are obligated to inform the owner of the Exclusive Control Zone and Territorial Waters of its passage, and only with consent can it penetrate the state waters.

(III) Any structure built in International Waters need to be 27nm away from any Exclusive Economic Zone.

(IIII) The coast state has sovereign rights over the seabed and airspace above the Exclusive Economic Zone.​

(V) The continental shelf is the submerged prolongation of the land territory of the coastal state.

(I) Coastal states who can demonstrate that its continental shelf continues beyond the 200nm of the Exclusive Economic Zone, are entitled to extend the limit of said Zone to include such area.

(II) Such extension cannot go beyond 60nm from the foot of the continental slope.​

(VI) The Antarctic Ocean, including for the purposes of the present Treaty all maritime areas below the 60° Parallel South, are not affected by the present Law of the Sea.

[CHAPTER 3, CIVILIAN MARITIME TRAFFIC]

(I) Civilian maritime traffic is understood as the totality of the civilian vessels navigating the maritime bodies of the planet.

(II) A civilian vessel is a ship that does not carry weapons other than in the form of cargo, both of public and private ownership and that carries a visible civil ensign.

(III) Privately owned ships are always considered as civilian vessels.

(IIII) Vessels designated for International Maritime Commerce cannot be used for military duties without loosing its designation as a civilian ship.

(V) Civilian Maritime Traffic can exercise the right of "Innocent Passage".

(VI) International commercial ships have to be on record via a public registry.

[CHAPTER 4, DISPUTES, CONTROVERSIES AND RESPONSIBILITIES]

(I) The sovereignty over the territorial sea is exercised subject to this Convention and to other rules of international law.

(II) Disputed waters are interpreted as a sector where sovereignty is contested by more than one nation, and recognized as such by the international community.

(III) Disputed Waters are left outside of the present Law, until the Coastal States disputing it resolve it. No military vessels from the coastal states involved in the dispute, with the exception of passage, are authorized to operate within the disputed zone.

(IIII) In cases where overlapping between the maritime areas of two or more coastal states occurs, the states involved are encouraged to define their "Respective Limits" on the base of mutual agreement.

(V) The nations are obliged to safeguard Maritime Traffic, Human Life and Maritime Environment by exercising control and policing duties on the vessels operating under their flag.

(VI) Failure to comply with the Present treaty can carry international responsibility for said State.
