Dear whom it may concern,
It has come to our attention that Polish Defense Exporters currently offers the purchase of the Orkan Class Fast Attack Ship on its website. As you are aware, the Orkan Class Fast Attack Ship is produced by the NKfM's consortium and are the intellectual property of NKfM's consortium of naval ships builders. As such their production and sale without approval from NKfM is an infringement on NKfM's intellectual property. We are eager to find an amicable resolution to this situation.

Under our Export Control Laws there are several measures which we hope PDE to apply to the Orkan Fast Attack Ship sale which are included below
  1. Purchasers engaging in transactions with Nationales Konsortium für Marineexporte cannot resell, trade/exchange, or donate/give away purchased equipment to third parties without express permission from Nationales Konsortium für Marineexporte or a letter of affirmative support from the German Federal Government.
  2. By utilizing the provided equipment, the user expressly consents to investigations conducted by the German Federal Government regarding the use of said equipment. Such investigations may include inquiries into compliance with applicable laws, regulations, and international agreements governing the use of German equipment.
Lastly we would like for Poland to pay a $250,000,000.00 license fee as well as a 5.5% profit fee per purchase of the Orkan Class Fast Attack Ship. Under these three terms we are happy to allow for the continued use of the vessel for commercial and personal use.

We hope to continue to strengthen our professional business relationship and believe that this is a reasonable alternative to allow PDE to continue to provide the defense product as a Polish Export while ensuring that this does not turn into a loop hole for foreign buyers to purchase German Products.
