1. Agreement a. The availing of all banking services, accounts and facilities offered by Polaris Banking is conditional upon the Customer's acceptance of these Terms (on your behalf and on behalf of each of your authorized agents), as amended from time to time in our sole discretion. b. These Terms create legally binding obligations between Polaris Banking and the Customer. These terms are applicable to all new and existing accounts with effect from the date these Terms appear. c. Operation of any account on or after the date on which an amendment to the Terms comes into effect will constitute acceptance of such an amendment by you without reservation. 2. Account Openinga. An account can be opened in the name of one person or jointly in the name of two or more persons, or when concerning a corporate account in the name of the legal individual responsible for financial activities (such as the President, CEO or CFO). b. Approval of eligibility for an account and facilities shall be subject to Polaris Banking's prevailing policies, criteria and procedures. c. Polaris Banking reserve the right to refuse an application for an account in our absolute discretion and may at our sole discretion, withdraw at any time all rights and privileges pertaining to the account. d. Accounts opened with Polaris Banking are subject to various requirements including but not limited to minimum balance requirements. Such requirements are dictated by our criteria and credit policies and limits and may be amended from time to time at our absolute discretion. e. The Customer has the right to view their electronic account statement at any time. To receive a paper Statements of Account, the Customer must submit a written request in respect thereof and we may levy a charge in our sole discretion. 3. Account Closinga. The Customer may close accounts at any time upon written notice to us. b. Closure of accounts by either the Customer or Polaris Banking shall not affect any rights or liabilities accruing prior to closure. c. Polaris Banking may withdraw all facilities, off-set funds or securities from the Customer's accounts against any indebtedness to us, and close accounts at our discretion. 4. Individual Checking Accounta. Individual Checking Accounts allow for individuals to secure their funds in a private or joint checking account. 5. Corporate Accounta. Corporate Accounts allow corporations to maintain an account with Polaris Banking which offers the same services as a ‘Business Account’ which is provided by the ‘Bank’ but at a much lower cost. b. Corporate Accounts may request the creation of up to seven (7) sub-accounts in order to categorise their account. 6. Deposita. Any deposits to your account must name ‘Polaris Banking’ as the recipient and your account number (PB/A/####) must be listed in the ‘Reason’ section of the transfer form. b. When a deposit is made to a Corporate Account, the sub-account to which the transaction should be deposited should also be listed in the ‘Reason’ section. i. In the event that a sub-account is not named, the funds shall be deposited in the account's primary sub-account (the first sub-account in the list). a. Any withdrawals made from your account must name ‘Polaris Banking’ as the ‘Sender’ section and your account number (PB/A/####) must be listed in the ‘Reason’ section of the transfer form. b. When a withdrawal is made from a Corporate Account, the sub-account from where the withdrawal is being made from must also be listed in the ‘Reason’ section. i. In the event that a sub-account is not named, the funds shall be withdrawn from the account's primary sub-account (the first sub-account in the list). a. Polaris Banking reserves the right to cancel any transaction made if the account balance would go below the minimum credit balance. b. Polaris Banking shall keep a record of all transaction in a secure database, account holders will have access to their records of transactions. 9. Internal Account Transfera. Customer's have the ability to transfer funds between their sub-account, this action is called an Internal Account Transfer (IAT). a. In order to perform an Internal Account Transfer the Customer must request this transfer and provide details including the amount and destination (contact Dutchy on Discord to perform this action). 10. Internal Transfera. In the event that a transaction is being performed between two Customer's, then this action is called an Internal Transfer (IT). a. In order to perform an Internal Account the Customer must request this transfer and provide details including the account number of the recipient and the amount that is being transferred (contact Dutchy on Discord to perform this action). 11. Fees and Chargesa. Polaris Banking may charge fees for the maintaining of an account, these charges shall be listed publicly. b. All fees and charges shall be automatically removed from your account at the beginning of each month. |
