Dear whom it may concern,

It has come to our attention that Polish Defense Corporations have begun production for the Polish Armed Forces with the following reference codes: Reference Number #28742 & #28741. As you are aware the Osa and Kub are the intellectual property of Rosoboronexport. Their intellectual property is assigned to Rosoboronexport as part of its consortium of partner entities. As such their production without approval from Rosoboronexpor sintellectual is an infringement on Rosoboronexport'sintellectual property and a violation of our terms and services.

We appreciate Poland's continued business and hope that we may find an amicable solution to allow for their construction. In lieu of blocking the production, we would like to offer Poland a limited domestic production right for a fee of $471,680,000 for the production of 64 Osa and 64 Kub Tridente-class ships. Under this limited domestic production, 128 air defense pierces may be built after which the production right would expire or may be renewed with an additional payment.

Thank you for reaching out to Polish Defense Acquisitions Department of the Ministry of National Defense in regards to a recent procurement attempt by the Polish Armed Forces for -64x 9K33 Osa SAM units- and -64x 2K12 Kub SAM units-. As of the receipt of this message, Poland has been utilizing these pieces of equipment before the formation of Rosoboronexport and before the last three administrations of Russia. While we may respect the idea that it may be an infringement on intellectual property, which can be argued against, we do not agree that it violates the terms and services of Rosobornexport as they were not purchased from them at any point in the history of the Republic of Poland nor the Kingdom of Poland.

As for continuing business with Rosoboronexport, we are not entirely removed from the idea as we have purchased a partnership from yourself prior to the regime change to President Nemetsov's administration. However, we must inquire as to the timely manner at which products will be delivered. Having previously attempted to purchase a number of naval vessels during the tenure of the previous administration, we found ourselves having to cancel a wire transfer of significant amount due to the delays in delivery and have sought additional equipment elsewhere because of this. If this practice were to continue, I feel Poland's Ministry of National Defense would have no other option but to forgo Russian/Soviet equipment all together for a more stable supplier.

Dear Dworak,

Rosoboronexport as an entity is the sole commercial distributor of Russian defense equipment for foreign markets as established by the Federal Law on Arms Exports and Controls. The Polish Government received its defense equipment from the Soviet Union and was transferred only user rights.

Consequently, any equipment previously produced or used was done so with user rights alone and not with any transfer of intellectual property rights. In line with international conventions on defense product rights, it is Rosoboronexport that retains the rights as the legal successor of Russian defense exporters through national laws.

Rosoboronexport on behalf of its consortium of national producers exercises federal controls on exports, re-sales, modifications, and usage of Russian equipment irrespective of when/where they were bought. In line with our national obligations and international tools, Rosoboronexport is fully entitled to cease any sourcing of parts necessary to build these air defense systems.

The proposal amicably applies the profit margins with no additional charges for domestic production and we believe it is fair in lieu of blocking the production and charging Poland for the production, service, and profit charges.

As far as a partnership is concerned, the Polish Government can be assured of Rosoboronexport's professionalism and I am happy to alleviate any potential concerns you can have. Global supply chain disruptions have increased the expected delivery dates for a large number of international customers and not exclusively from Russia.

If Your Government is eager to continue with its previous sale we will be sure to demonstrate that professionalism to you and provide you the background to make an informed decision about a partnership with Rosoboronexport.

While we still do not fully support the current stance of Rosobornexport and nations who utilized the equipment before the establishment of your corporation, we do respect the legal basis for Rosobornexports argument in the matter as the equipment is of Russian intellectual property. In an effort to promote peaceful dialogue and strengthening ties between the Kingdom of Poland and Russia, we have sent a wire transfer to the Russian Government containing the totaled amount listed in the original communication sent to me by your office.
