Open Letter to the Polish nation and its government

Subject Demand for Human Rights Assurance

Dear the authorities of Poland and the free people of the world,

We, the undersigned, demand an impartial and inviolable justice as proclaimed in the Universal Declaration of Human Rights (herein referred to as "UDHR") for five Thai citizens (herein referred to as "people") beings held in Poland.

Per Article 3 of the UDHR, "Everyone has the right to life, liberty and security of person." We demand that our people have access to their convenient way of daily life, freedom in their actions and thoughts under the rule of law, and no infringement on their security.

Per Article 5 of the UDHR, "No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment." We demand that our people are treated fairly and safely, ensuring no infringement, harm, or inhumane treatment to their health, mental wellness, and personal security.

Per Article 6 of the UDHR, "Everyone has the right to recognition everywhere as a person before the law." We demand that, with no rule of law standing above, the recognition that our people are human beings as to any individual currently living or demise in Poland and our Earth. Thus, they must be treated impartially with no exception of any kind, such as race, color, sex, language, religion, political or other opinions, national or social origin, property, birth or other status

Per Article 7 of the UDHR, "All are equal before the law and are entitled without any discrimination to equal protection of the law. All are entitled to equal protection against any discrimination in violation of this Declaration and against any incitement to such discrimination." We demand that our people receive and have access to the same protection from discrimination from any kind of governmental authorities, the Polish people, and any individual.

Per Article 9 of the UDHR, "No one shall be subjected to arbitrary arrest, detention or exile." We demand that our people are not subjected to any kind of arbitrary arrest, detention, or exile without the lawful and internationally recognized decision of the public court and trial.

Per Article 10 of the UDHR, "Everyone is entitled in full equality to a fair and public hearing by an independent and impartial tribunal, in the determination of his rights and obligations and of any criminal charge against him." We demand that our people have access to and receive impartial and public trial.

Per Section 1 or Article 11 of the UDHR, "Everyone charged with a penal offense has the right to be presumed innocent until proven guilty according to the law in a public trial at which he has had all the guarantees necessary for his defense." We demand that our people be presumed and treated as innocents according to the law in a public trial. Our people must have access to comprehensive and legitimate documents and information from the investigation for their defense.

Per Article 25 of the UDHR, "Everyone has the right to a standard of living adequate for the health and well-being of himself and of his family, including food, clothing, housing and medical care, and necessary social services, and the right to security in the event of unemployment, sickness, disability, widowhood, old age or other lack of livelihood in circumstances beyond his control." We demand that our people have access to and receive adequate support and assurance of their adequate standard of living for their health and well-being.

We hope that you receive and acknowledge our demand for the assurance of our people's human rights.

Thai Ministry of Justice and the People of the World,

As a staunch member of the Global Assembly and all its undersigned Resolutions, follows all resolutions passed by the entity known as Global Assembly. Furthermore, as the Universal Declaration of Human Rights was a resolution passed by the organization that worked prior to the United Nations and not adopted by the Global assembly Poland is not obligated to follow the stated resolution.

However, Poland's constitution(Article 42.2) states that 'anyone against whom criminal proceedings have been brought, the right to defence at all stages of such proceedings, in particular by benefiting from the legal assistance of an attorney.'

Furthermore, Poland's Constitution(Articles 40) states 'Freedom from torture or cruel, inhumane, or degrading treatment or punishment.

Furthermore, Poland's constitution(article 41) states 'Right to personal inviolability'.

Furthermore, Poland's Constitution(Article 45) states 'Right to a fair and public hearing before a competent, impartial and independent court.'

However, due to the nature of the crime and the information that may be forthcoming regarding to nation security risks for both the Republic of Thailand and the Kingdom of Poland, we have elected to host a private trial to limit the exposure of classified information that may include information regarding ongoing, or former, operations that could cause undue risk and harm for those involved. Unlike the Republic of Thailand, the Kingdom of Poland does not wish to cause undue harm or risk to active service members of a nation's armed forces or intelligence agencies. Furthermore, The Polish Ministry of Internal Affairs and Administration feels this is an attempt of the Thai government to cast aspersions to the Kingdom of Poland and it's government and condemn the action for calling Poland's commitment to human rights in question, bordering on libel and slander.

Poland has always been a staunch proponent of a individual's human rights and will continue to be so, despite the troubles times the Kingdom finds itself in. We can, however, confirm that the incarcerated will be given access to a fair trial lead by an impartial judge as well as access to a public defender for their defense.

We acknowledge your response concerning the legal proceedings against the Thai nationals detained in Poland. As the Ministry of Justice of Thailand and representing over 2 million signatories, we reiterate our commitment to upholding the highest standards of international law and human rights, consistent with Thailand's standing as a responsible member of the global community.

We appreciate Poland's adherence to its constitutional commitments to human rights and the rule of law. However, we must express our concerns regarding the decision to hold a private trial. While we understand the sensitivity of the information involved, transparency is a cornerstone of justice. A private trial, especially in a case with significant international implications, raises concerns about the fairness and impartiality of the proceedings. The international community's oversight and the presence of independent observers are essential to ensure that justice is not only done but seen to be done.

Regarding the accusation of casting aspersions, our intent is not to slander the Kingdom of Poland. Instead, we seek to ensure the protection and fair treatment of our citizens. We believe that questioning and holding states accountable to their human rights commitments should not be construed as an attack, but rather as a necessary part of upholding international norms and values.

To address the concerns about national security risks, we propose the involvement of a neutral third-party international body to oversee the trial. This would help balance the need for confidentiality with the imperative of transparency and fairness. It would also serve to safeguard the interests of both Thailand and Poland, ensuring that justice is administered without compromising national security.

We are reassured by your commitment to provide access to a fair trial and legal representation. We urge that these rights be upheld in practice, with all due consideration given to the international nature of this case and its potential impact on the relations between our two nations and the broader international community.

In closing, we emphasize our commitment to constructive dialogue and legal resolution. We hope for a fair and just outcome that respects the rights of the individuals involved and upholds the principles of international law and human rights.
