TERMS & CONDITIONS

1. These Terms and Conditions (the "T&C") set forth the terms and conditions governing the public procurement procedure (the "Procedure") by TenderNed (the "Procuring Entity"). The Procuring Entity is inviting proposals (the "Proposals") from qualified and competent bidders (the "Bidders") for the procurement of [Goods/Services] (the "Procurement").
2. Only Bidders who meet the following eligibility criteria will be considered for participation in the Procedure:
a. The Bidder must have a valid and current business licence and tax registration.
b. The Bidder must have demonstrated experience in providing similar goods/services to those required under this Procurement.​
3. The Proposals must be submitted in accordance with the following requirements:
a. The Proposal must be submitted in writing to the Procuring Entity in the Dutch or English language.
b. The Proposal must include all required information, documents, and materials as specified in the Request for Proposal (RFP) document.
c. The Proposal must be submitted by the deadline specified in the RFP.​
4. Evaluation of Proposals The Procuring Entity will evaluate the Proposals based on the following criteria:
5. Compliance with the requirements set forth in the RFP.
a. The Bidder's technical qualifications, experience, and expertise.
b. The Bidder's proposed price and value for money.
c. The Bidder's financial stability and capacity to perform the contract.​
6. The Procuring Entity will award the contract to the Bidder whose Proposal meets all the requirements and offers the best value for money, as determined by the evaluation criteria.
7. All Proposals and related documents submitted by Bidders will be kept confidential by the Procuring Entity and will not be disclosed to any third party without the Bidder's consent, except as required by law.
8. The Procuring Entity reserves the right to amend or cancel the Procedure at any time prior to payment and for any reason without liability to any Bidder.
9. Any agreement shall be governed by and construed in accordance with the laws of the Kingdom of the Netherlands.​
