I. EXECUTIVE SUMMARY

This memorandum establishes the legal basis, procedural framework, and operational constraints under which the Celestial Army and organs of state intelligence are authorised to execute death warrants, certified as final by the Celestial Judiciary, against condemned persons who have fled to foreign jurisdictions and remain beyond the reach of conventional extradition mechanisms. Such authority is to be invoked exclusively in extreme circumstances as defined herein, and subject to mandatory multi-tier authorisation.

Nothing in this memorandum shall be construed to authorise operations inconsistent with an explicit Celestial Council prohibition, nor to confer unlimited discretion upon operational commanders. The power described herein is extraordinary in character and shall be exercised with commensurate restraint.


II. LEGAL BASIS

The following instruments of Celestial law collectively vest the authority described in this memorandum:


1. Celestial Constitution, Article 2 — The sovereignty of the Empire attaches to all persons subject to its jurisdiction regardless of their physical location. No foreign territory shall serve as a sanctuary from the lawful judgements of the Empire.

2. Celestial Criminal Code, Book VII, Part III (Penalties of the Final Degree: Enforcement Provisions) — Affirms the duty of all organs of the state to give effect to sentences of death duly imposed by competent courts.

3. Decree of the Restoration Council No. 14, Year 1 of the Celestial Restoration — Establishes the primacy of Celestial law over the acts and laws of foreign states in all matters concerning Celestial nationals, enemies of the state, and persons adjudged guilty by Celestial courts.

4. National Security Act, Year 2 of the Celestial Restoration, Section 31 — Authorises covert operations beyond the territorial boundaries of the Empire where necessary for the defence of Celestial interests, or the protection of Celestial citizens.

5. Supreme Court of the Realm Rules, Procedure No. 7 (Finality of Capital Sentences) — Establishes the procedure for certification of death warrants as unappealable and ready for execution.


III. DEFINITIONS

For the purposes of this memorandum, the following definitions apply:


(a) Condemned Person — Any individual against whom the Supreme Court of the Empire, or a duly constituted Celestial Tribunal of competent jurisdiction, has issued a sentence of death that has been certified as final and unappealable under Supreme Court of the Realm Rules, Procedure No. 7.

(b) Certified Death Warrant — A warrant of execution bearing the seal of the Chief Justice and countersigned by the Minister of Justice and Moral Rectitude, confirming exhaustion of all appellate remedies and the legal readiness of the sentence for enforcement.

(c) Extreme Circumstances — A conjunction of conditions, all of which must be simultaneously satisfied, constituting the threshold for invocation of this directive:

(i) The foreign state in which the condemned person is present has refused a formally submitted extradition request under applicable treaty or customary international law, or the Empire and the host state are party to no extradition arrangement and informal channels have been exhausted;

(ii) The condemned person poses an ongoing, demonstrable, and specific threat to the security of the Empire, the safety of Celestial citizens, or the integrity of Celestial institutions, as assessed in writing by the Director of Imperial Intelligence;

(iii) All conventional law enforcement mechanisms — including diplomatic pressure, international police notices, and third-state intermediary requests — have been exhausted or assessed in writing as infeasible within a reasonable operational timeframe; and

(iv) The Celestial Council has by supermajority vote (not less than five of seven members) certified the matter as warranting extraordinary extraterritorial action.

(d) Authorised Force — The Special Operations Bureau of the Imperial Intelligence Directorate and/or the Special Warfare Command of the Celestial Army, acting pursuant to a joint operational order issued under this directive.

(e) Host State — Any foreign sovereign state or territory in which the condemned person is present at the time of the operation.


IV. AUTHORISATION PROCEDURE

Operations conducted under this directive shall proceed through the following mandatory sequential stages. No stage may be bypassed or compressed without unanimous Celestial Council consent recorded in writing.


Stage 1 — Judicial Certification

The Supreme Court of the Realm, upon final disposition of all appeals and extraordinary remedies, shall issue the Certified Death Warrant in accordance with Supreme Court of the Realm Rules, Procedure No. 7. The Chief Justice shall transmit the Certified Death Warrant to the Minister of Justice and Moral Rectitude and simultaneously notify the Celestial Council of its issuance. The warrant shall specify: the full identity of the condemned; the offence or offences of conviction; the date of final judgement; and confirmation that all ordinary and extraordinary appellate procedures have been exhausted.


Stage 2 — Executive Determination

Upon receiving confirmed intelligence that the condemned person is present in foreign territory, the Minister of Justice and Moral Rectitude shall submit to the Celestial Council a written Extraordinary Enforcement Determination. The Determination must attest to each of the four conditions constituting Extreme Circumstances as defined in Section III(c), and must append: (i) intelligence assessments from the Director of Imperial Intelligence; (ii) a certified record of extradition requests and their outcomes; and (iii) a legal opinion from this Office confirming satisfaction of all threshold conditions.


Stage 3 — Celestial Council Authorisation

The Celestial Council shall convene in closed session to consider the Extraordinary Enforcement Determination. Authorisation shall require an affirmative vote of not less than five of seven members. The authorisation shall be recorded as a Sealed Celestial Order, bearing the seals of all affirmative members, and shall remain classified at the Most Secret level. The Sealed Celestial Order shall specify: the identity of the condemned; the host state; the operational window as determined by the Celestial Council in its discretion; the Authorised Force designated to execute the warrant; and any specific operational constraints imposed by the Council.


Stage 4 — Operational Planning and Execution

Upon receipt of the Sealed Celestial Order, the Imperial Intelligence Directorate and Supreme Command shall convene a Joint Operational Planning Group. The Group shall produce a classified operational plan addressing: identity verification protocols; method of execution consistent with the condemned's sentence; measures to minimise collateral harm to persons not subject to the warrant; contingency procedures in the event of operational compromise; and provisions for the preservation of operational records. The Authorised Force shall not initiate the operation prior to receiving written operational authorisation from both the Director of Imperial Intelligence and the Commander, Special Warfare or their authorised delegates.


Stage 5 — Post-Execution Report

Within thirty days of execution of the warrant, the Authorised Force shall submit a classified After-Action Report to the Celestial Council. The Report shall include: (i) confirmation of the identity of the person upon whom the warrant was executed, with supporting biometric or equivalent evidence; (ii) the method by which the sentence was carried out; (iii) an assessment of collateral effects, if any; (iv) any operational deviations from the approved plan and their justification; and (v) recommendations for modification of this directive, if any are warranted by operational experience.


V. OPERATIONAL CONSTRAINTS AND LIMITATIONS

All operations conducted under this directive are subject to the following binding constraints, non-compliance with which shall constitute a criminal offence under Book VII of the Celestial Criminal Code and, where applicable, the Military Justice Code:


1. Identity Verification. Prior to execution, the Authorised Force must independently and positively verify the identity of the condemned person through biometric matching, photographic confirmation against official records, or equivalent means approved in the operational plan. Execution of the directive against the wrong person constitutes an offence of criminal homicide under the Celestial Criminal Code and shall not be excused on grounds of good faith error if prescribed verification procedures were not followed.

2. Minimum Necessary Force. Operations shall employ only the minimum force necessary to execute the warrant. Wanton destruction of foreign property, harm to uninvolved third parties, and indiscriminate methods are absolutely prohibited.

3. Temporal Limitation. Authorisation under a Sealed Celestial Order expires upon the conclusion of the operational window as determined by the Celestial Council pursuant to Stage 3. Any extension requires a renewed vote of the Celestial Council by the same supermajority threshold.

4. Non-Delegability. The authority conferred by this framework upon the Authorised Force may not be sub-delegated to private contractors, mercenary entities, or foreign agents without specific and explicit authorisation in the Sealed Celestial Order.

5. Inapplicability to Non-Capital Sentences. This directive applies exclusively to Certified Death Warrants. It does not authorise extraterritorial enforcement of any lesser sentence, nor the apprehension of persons for return to the Empire, absent separate authorisation under applicable law.

6. Prohibition on Unauthorised Treatment. The condemned shall be executed in accordance with the form of the sentence as imposed by the court. The Authorised Force is prohibited from inflicting suffering or degradation beyond what is incident to lawful execution of the warrant.


VI. LEGAL OPINION OF CELESTIAL LEGAL COUNSEL

It is the opinion of this Office that the extraterritorial enforcement of Certified Death Warrants pursuant to the framework set forth herein is lawful under the Celestial Constitution, domestic statute, and the foundational instruments of the Celestial Restoration.

The sovereignty doctrine enshrined in Article 2 of the Celestial Constitution and affirmed by Decree No. 14 of the Restoration Council establishes as a matter of Celestial constitutional law that the judgement of the Empire over its subjects and enemies follows those persons wherever they may go. No act of concealment in foreign territory extinguishes a Celestial judgement, nor does any foreign state acquire the right, by the mere fact of harbouring a condemned person, to frustrate the execution of that judgement.

It is acknowledged that operations conducted under this directive may conflict with the domestic law of the host state and may be characterised by certain foreign governments as inconsistent with principles of sovereign equality under general international law. The Empire does not accept that such characterisations have legal force as against Celestial authority. The Empire's consistent and publicly stated position, reaffirmed in Decree No. 14, is that no state may lawfully function as a sanctuary for persons condemned under the laws of the Empire.

The multi-stage authorisation procedure required under Section IV provides sufficient safeguards against arbitrary or erroneous invocation of this extraordinary authority. The requirement of judicial certification, executive determination, and supermajority Celestial Council approval ensures that the directive will be invoked only where the full weight of Celestial governmental authority has been engaged and found, by substantial consensus, that no alternative recourse remains available.

This Office therefore advises that the framework as described is legally sound and may be promulgated as standing Celestial policy upon approval of the Celestial Council.


VII. REVIEW AND AMENDMENT

This memorandum constitutes standing Celestial policy upon approval by the Celestial Council. The Office of Celestial Legal Counsel shall conduct a formal review of this framework every three years from the date of approval, or upon any material change in the relevant provisions of Celestial law, the Celestial Constitution, or Celestial national security policy, whichever is the sooner.

Proposed amendments shall be submitted by the Minister of Justice and Moral Rectitude or the Director of Imperial Intelligence to the Celestial Council for approval. Emergency amendments in exigent circumstances may be authorised by the Celestial Council by simple majority, subject to formal ratification at the next regularly convened Celestial Council session.
