Your Excellency,

I understand that the Empire of Myanmar is not a member of the Global Assembly, however, the Socialist Republic of Thailand is. With that said, the Empire of Myanmar submits this formal request to the Global Assembly and its affiliated judicial organ, the International Court of Justice (ICJ), to initiate an impartial and transparent investigation into the events leading to the unlawful infiltration of armed Thai military personnel into Myanmar just over two years ago.

As is known, ninety-five (95) Thai soldiers were captured within our sovereign borders during a covert operation that, by their own testimony, was directly ordered and sanctioned by the government of Thailand under Prime Minister Thaksin Shinawatra—the same individual who currently holds office and continues to represent the Thai nation before this esteemed body.

These individuals were not rogue actors, nor were they operating in defiance of their government’s directives. Quite the opposite. Interrogations and verified communications revealed that their mission was to provide support and intelligence to insurgent groups with the objective of destabilizing the former Myanmar regime and undermining our national sovereignty through clandestine paramilitary engagement. To what end? We are unsure. But I believe we can both agree that this action is a horrible violation of the rights a nation and its people hold in international law.

No doubt, when this issue is brought to the floor, the Thai government will adopt familiar language: that this occurred under “a different government,” or that these actions were committed by “unauthorized agents.” However, the facts are clear:
  • Prime Minister Thaksin Shinawatra was in power at the time of the operation, and he remains in power now.
  • Captured personnel have confirmed, without coercion, that their orders were to assist resistance factions in toppling the then-military government.
  • This operation constituted an armed violation of national sovereignty, regardless of regime type or political disposition.

Myanmar is aware of the complex history between our nations. But we assert that sovereignty must not be subject to the shifting justifications of regional actors. If member states of the Global Assembly are allowed to dismiss transgressions as the mistakes of "former administrations," then the very principles of accountability and international law are eroded beyond recognition.

Therefore, the Empire of Myanmar formally invites a delegation from the International Court of Justice to travel to our territory, conduct a full and independent fact-finding mission, and determine whether Myanmar has standing to initiate proceedings against the Socialist Republic of Thailand for violations of:
  • International sovereignty.
  • Instigating insurgencies within our nation.
  • Sending armed soldiers through our borders.

We believe such an inquiry is in the interest of global stability, legal precedent, and the enduring credibility of the Global Assembly as a platform of fairness and justice.

Myanmar will extend full access and cooperation to ICJ officials. We are prepared to furnish documented evidence, interrogation transcripts, communication logs, and detained personnel for questioning by international legal experts.

We await the Global Assembly’s response and trust that it will uphold the very values it was established to protect.

Your Majesty,

I have the honour to respond to Your Majesty’s request for an independent investigation into the circumstances surrounding the unlawful infiltration of armed Thai military personnel into the territory of Myanmar. In doing so, I respectfully present the interpretation of the Office of Legal Affairs regarding the legal avenues available in this matter.

The International Court of Justice was established to adjudicate legal disputes and to render advisory opinions in accordance with international law. While the Court may, in the context of a case before it, entrust the task of conducting an inquiry to an individual, body, bureau, commission, or other organisation of its choosing, such authority may only be exercised in relation to a matter that has been formally submitted to the Court.

Under its Statute, the Court may hear cases involving legal disputes between Member States, disputes between Member States and the Secretariat, or matters arising under treaties and conventions in force between the disputing parties. Additionally, state parties may jointly agree to submit a case to the Court for adjudication.

In the context of Your Majesty’s request, the matter would first need to be jointly submitted to the Court by both the Empire of Myanmar and the Socialist Republic of Thailand. Only upon such submission could the Court consider authorising an investigation.

Alternatively, a fact-finding investigation could be authorised outside the judicial framework of the Court, the Assembly may, through the adoption of a resolution, mandate the Secretariat to conduct such an inquiry. In the absence of such a mandate, I am, however, not empowered to initiate the requested investigation.

I trust this response provides clarity regarding the mechanisms available should Your Majesty wish to pursue this matter further.

Your Excellency,

Thank you for your timely and thorough response to our petition.

While we appreciate the clarification of the procedural limits placed upon the International Court of Justice under its current Statute, it is nonetheless troubling that such an egregious violation of international law—acknowledged in both witness testimony and captured communications—remains outside the reach of immediate judicial inquiry without the express consent of the offending party. That the victim of such an incursion must rely on the cooperation of the aggressor to even initiate a hearing presents a troubling precedent and one that invites abuse.

Myanmar therefore formally requests that the matter be brought before the Global Assembly for consideration of a resolution mandating the Secretariat to initiate a fact-finding mission. In our view, this is the most effective path to a fair and independent determination of the facts, and it does not rely on the cooperation of the very state accused of violating the international order. We would be very thankful if you would be able to give us details, guidelines, and steps towards accomplishing this.

I understand the concerns raised, and I believe it prudent to instruct the Office of Legal Affairs to undertake a review of the Statute of the Court in relation to this matter. However, I wish to reiterate that the Global Assembly is a member-based organisation. It is the rights and privileges of membership that unite most nations within this international forum. Should the Empire of Myanmar express interest in pursuing membership, whether full or as an observer, I would be honoured to appoint a representative of the Secretariat to engage in discussions regarding the membership process.

For this matter to be formally brought before the Assembly, a member state must either request a debate through the President of the Assembly or submit a draft resolution to the Office of Legal Affairs. I therefore encourage your government to engage with a member state willing to initiate one of these procedures. The Office of Legal Affairs stands ready to assist in the preparation of any draft resolution, ensuring that it contains the necessary provisions for clarity and coherence, and that it aligns with the principles of international law.​

I thank you for your response and for the clarity you have provided. The Empire of Myanmar will indeed seek a willing member state to introduce the case before the Global Assembly on our behalf. I am confident that such a nation can be found in the coming months.

Furthermore, I wish to express our formal interest in becoming an observer state within the Assembly. Myanmar recognizes the value of international dialogue and would be honoured to begin the process of engaging more fully with the global community. To that end, I kindly request a detailed summary of what this status entails, the procedures required for application, and any obligations or expectations that may be demanded of Myanmar as an observer state.

By becoming an observer state, we hope to better understand the Global Assembly and, if, we approve of what we see then we will begin steps to becoming a full member state.
