Subject: Notification of Infringement
Your Excellency,
My Office has recently been made aware of your claimed 'Ottoman Maritime Exclusion Zone'. While it is generally within the rights of a state to govern their territory, the Turkish state is bound by the Montreux Convention Regarding the Regime of the Straits. Your stated policy is in violation of this treaty on the following grounds.
Article 2:
In time of peace, merchant vessels shall enjoy complete freedom of transit and navigation in the Straits, by day and by night, under any flag any and with any kind of cargo, without any formalities
Article 10:
In time of peace, light surface vessels, minor war vessels and auxiliary vessels, whether belonging to Black Sea or non-Black Sea Powers, and whatever their flag, shall enjoy freedom of transit through the Straits without any taxes or charges whatever, provided that such transit is begun during daylight and subject to the conditions laid down in Article 13 and the Articles following thereafter
As this Convention remains in force, French vessels will continue to act in compliance with all articles of the Convention as well as customary international law. Any attempt to interfere with French vessels exercising their freedom of navigation, except for those restrictions specifically authorized by the Montreux Convention, the Global Assembly, a binding agreement France is a party to, or customary international law, will be considered an act of war against the Empire of France. In such a case we will exercise our right to self-defence in accordance with international law and call in our allies to protect our fundamental rights.
This notification will serve as our one and only warning.
