"It appears that the minister is not on his way, I've just been informed that his plane from America Is infact on it's way to Brazil. The USAF is currently treating this as a potential hijacking as the reroute wasn't cleared with ATC"

"Minister Juan DeSilva will appear at the Hague within two days time," declared the Brazilian representative at the ICJ.

"For starters, he needs the time to consult with and also bring lawyers from Brazil to the ICJ.

Second, given the duress he was under in the United States, it cannot be understated that he could not come here directly from the hellhole Washington D.C. is, without proper rest and without proper counsel.

I will notify all of you the second he departs Brasila."

"Minister DeSilva has forty-eight hours to get here, otherwise we will be forced to begin the trial without him. We will reconvene here at this time in two days." Olhouser slammed his gavel and permitted everyone to leave.

[OOC: You have 24 hours from the time this post has been posted to have him arrive.]

Chief Justice Olhouser returned to the chamber, presumably with the other judges, in exactly forty-eight hours time as promise. Only the justices, the prosecution, and the accused (who is not present) were allowed into the chamber. He slammed his gavel at the forty-eight hour mark.

"I hereby call this session of the International Court of Justice to order. The reporter will begin the record. We are convened to hear case #003, Chapuis v. DeSilva. The accused was given forty-eight hours to arrive, yet we have not received any official word from his government or himself. I have been given no indication from the Dutch that he is currently in route to or within The Netherlands. Therefor, in accordance with Article 1, Chapter 3, Section 8, myself and the other justices are no longer bound to the assumption of innocence for the accused. In order to exhaust all avenues of leniency, I will extend Minister DeSilva's time to arrive until the end of the prosecution's presentation of their case."

Olhouser looked over at the French Ambassador, who presumably had an attorney with her. "Counselor, we have the evidence you've submitted to the court. However, if you would like to submit your case for the record, we would be happy to hear it. After your case has been presented, assuming we have no questions and the defendant doesn't arrive, we will vote as to whether he is guilty or not guilty... The floor is yours," he said as he waited for the French to offer their side of the story.

Unless the Swedes were part of the prosecution or defense, they were not allowed to enter the chamber. It was explained that this was not a slight against them, but that the International Court of Justice did not allow audiences.

The Brazilian ICJ Representaive would announce the Foreign Minster Juan De Silva has just departed Brasilia in an Embraer Lineage 1000 jet. He will bring with him two defense attorneys, two unarmed bodyguards, two assistants and his files/laptops for his defense.

The Embraer will first fly to Lisbon Airport, Peru, quickly refuel and then fly directly to Amsterdam, Netherlands, while avoiding French airspace.

Route:HI>HJ>HK>HL>HM>IN>JO

Dutch Air Traffic Control would direct then Brazilian Embraer away from Amsterdam Airport Schiphol and guide them to land at Rotterdam The Hague Airport. Upon arrival all members would be fast tracked at passport control and customs and would be allowed into the country after it was insured they were not carrying any weapons.

A National Police escort would be provided to the Brazilian delegation, the convoy heading to the Peace Palace in The Hague.

Arriving at the International Court of Justice the Royal Netherlands Marechaussee would take over the protection duty from the National Police. The delegation would be escorted through the building, the foreign minister, attorneys and assistants would be allowed into the chamber, the Marechaussee would request the bodyguards to wait outside the chamber.

Note this reply is to help move on the roleplay, I remain on leave until 22/02.

The French Ambassador would stand, with a document filled with papers in hand.

"To begin with, the French government has placed forth our accusations against Minister Juan DeSilva in breaking the Global Assembly's Resolution for International Relations by threatening the French Minister of Economics, Mohammed Ahmed, and threatening the Executives, Fernand Choquet and Dominique Chauve, who had been sent to Brazil with our Minister to discuss potentially opening factories in Brazil. The three men that have been threatened by Minister Juan DeSilva have appeared in Court to testify to these threats.

But before I call forth my witnesses, I would like to offer the Court physical proof of this event actually occurring before Brazil can begin denying anything ever happened. First is the copies of the emails that we've made about working out a meeting between the French Minister of Economics, the two Executives, and the Minister of Foreign Affairs for Brazil. Furthermore, an Italian who was visiting Brasilia at the time was able to capture a short video of a confrontation between Minister Mohammed Ahmed and Minister Juan DeSilva. The video was uploaded to YouTube and if you listen close enough, you'll be able to hear a few words that were exchanged."

The French Ambassador would bring forth her first witness, Minister Mohammed Ahmed. A Guru Granth Sahib book would be brought forth for the Minister to swear upon to promise on everything he believed and respected that he was in going to speak nothing but the truth. Once the oath was taken, Mohammed Ahmed would take the stand as a witness.

"Minister Mohammed Ahmed, would you please be able to explain and describe to the court what had happened between you, the Executives, and Minister DeSilva and the conversation that brought upon the threats that were thrown at you and your party?"

Minister Ahmed would nod. " I remember it perfectly, how couldn't I when my life was threatened?" He'd begin. " It all began when Brazil made that childish remark towards Taiwan, the remark was made live and you'll likely still be able to find it mass posted on the media. Regardless, Brazil's remark towards Taiwan was quote 'that turd floating in the South China Sea, Taiwan?' unquote. When that remark was made live by Brazil, I was on the phone with Minister Florence Parly, she told me that I should return to France immediately for the safety of myself and the executives that were with me. I informed Minister DeSilva that the Executives and myself had to leave France for matters that were 'out of my hands' and that I apologized deeply.

In return, he replied that the Brazilian workers at the International Airport of Brasilia had gone on strike and that the 'Diplomatic Shuttle service, for some reason had been shut down for the day'. He continued to state that the hotel room we had rented had 'unarmed guards' and that he hoped those airline workers on strike 'did not have any friends in the hotel industry', a clear 'hope' that no one would attack us in our hotel room guarded by unarmed guards. Furthermore, he stated that France had 'canceled diplomatic relations or closed embassies and consulates', which was entirely false as that did not happen until days after the meeting when Brazil themselves canceled their diplomatic relations and closed their embassies and consulates to France themselves. Regardless, he continued to say that Brazil had blocked off these embassies and consulates, which not only would've been against international law but was entirely false as no evidence of that happening surfaced and I concluded that Minister DeSilva was only attempting to put us in harms way as he recommended for us to 'sit in the Air France Executive Suite of Brasilia International Airport' which would've brought us closer to these strikers which he had stated a few sentences before that they were potentially hostile people.

So I defended myself and the Executives with me, as was my responsibility by telling him that our pilot and our plane was from France and certainly would not be joining in on the strikes. In return, Minister DeSilva told us many things, such as: 'Are you yourself going to pump the fuel into the engines? Stock the plane with snacks? Are you going to get permission from ATC's to take off? Or are you willing to endanger the lives of others by acting foolishly?' and 'Your planes are going nowhere. So I suggest you take a seat in the France Air Executive Lounge and shut up.' Now if you ask me, that's an attempt in covering up the threat of shooting down or plane. I know my laws quite well, and I don't mean to speak for the Justices, but I told DeSilva that he was quote 'a buffoon' unquote and reminded him of the laws. Which is when the Italian visitor filmed the video.

He took my warning and upon returning to France I informed my government of what had happened and now, here we are."

The French Ambassador would smile. "Thank you, Minister Ahmed, that's all we needed. If it's also okay with the Chief Justice, I would like to call forth witnesses from two other foreign nations that have suffered injustice by Minister Juan DeSilva; Sweden and Taiwan."

Minister Juan DeSilva would rise and speak.

"Since neither Taiwan nor Sweden, are allowed in the chambers. I will take my turn and speak.

I think we should first define injustice. Injustice is a lack of unfairness or an unjust act. "

He would smile and look at the French representative.

"Due to my President's unkind remark's towards another country. You decided to pull out of trade talks with mine. This is your prerogative. It is also my countries prerogative to close embassies if we feel our nationals abroad may be subject to threat or harm. Or, we no longer feel the need to conduct diplomatic business with countries unkind to us.

Which is what we chose to do with France.

Despite there being an airline strike in Brazil at the time, we managed to safely escort your diplomats out of Brazil unscathed, yet my diplomats are still in France because your government is incapable of keeping peace in its own capital and my diplomats are still sitting in Paris.

And this nonsense of an Italian filming, filming what, your diplomats being escorted out of the airport safely. Is that your best case?

As far as bringing forth other countries " that have suffered injustice" at my hands .

Are Twitter spats going to be brought to ICJ from now on?

Is this your case?

The bottom line is, I allowed your diplomats to leave after you began crying because I insulted an ally of yours. My diplomats are still stuck in Paris, because you, as a country cannot even control your own capital city from a yellow-vest movement.

If there should be anyone on trial it should be the government of France!

What my president said was offensive, and I agree.

But your actions and words make the case worse for France.

And I will just repeat it once more.

Your diplomats are out.

Mine are still stuck in Paris.

Because you admittedly have no control over your own country.

But You want to bring Brazil to the ICJ?

Thank you, I am done.

Olhouser gaveled down Minister DeSilva until he stopped speaking, "The defense is out of order. It is not your turn to speak, the court reporter will strike anything just said by Minister DeSilva from the record. Ambassador Chapuis, you may call your witnesses from Sweden and Taiwan."

Olhouser looked to the back of the room where the Royal Marechaussee were guarding the door, "Gentlemen, allow the Swedish and Taiwanese witnesses in." The Swedish and Taiwanese witnesses - and them alone - were allowed into the chamber to testify. They would only be permitted to answer questions by the prosecution for now.

The Ambassador would take mental note of the Minister's poor attempt at defending himself.

"Thank you, Justices."

The French Ambassador would look at her paper.

"We would like to call forth; the Swedish and Taiwanese delegates to be asked questions regarding the injustice done to them by Minister DeSilva."

"Thank you for appearing, sir and madame. Before we begin I would ask that you swear the oath before the Court to assure us that you are in fact telling us the truth and know the consequences if you lie before the Court. Ms. Quinlivan, Sir representative, is there any specific item you would like to use to swear the oath? The Bible, your country's flag, other holy books?"

Jon Gvask, a lawyer from the Swedish Department for Justice, would lean slightly towards the microphone within the stand for the benefit of the court.

“I’d like to swear my oath to the Swedish flag, please”

Both witnesses were sworn in under the proper procedures so that they would tell the truth, the whole truth, and nothing but the truth. They were now prepared to be questioned by the French.
