THE INTERNATIONAL COURT OF JUSTICE The International Court is established through the adoption of the Global Assembly Charter and Stature of 2010. The Court is located in "The Hague, Netherlands" which reports directly to the Assembly and her members. The function of the Court of Justice — (I) To settle Legal Disputes submit by the States, in accordance with International Law (II) Give Advisory Opinions on legal questions, by AUTHORISED Members of the Global Assembly (III) Decides cases on the basis of International Law, as it exists on the date of the decision (IV) Apply existing, recognised rules or principles of law to the questions before it. These rules and principles may be developed, adapted, modified and interpreted in the context of specific cases, because all systems of law are incomplete. [CHAPTER 1, ARTICLE 1] Her Members of the Global Assembly will elect 6 NON Permanent members to serve as Judges to the International Court for a term of 1 (OOC) Year from High Moral Character, who we think possess the qualifications required for office. "Veto Power" will not be adopted to prevent any obstruction with official actions of the Secretary General and the interests of the Assembly. The Court will report directly to the Secretary General — (I) Elections to the International Court of Justice is open to all Member States of the Global Assembly. Elections will be held Per 1 (OOC) Year. The Secretary General is the "Presiding Officer" of the Court. He has 1 vote, and will decide what cases may be heard in the court. (II) There must be a FAIR Distribution of Elected Members, in accordance with Geographical Representation. (Representation applies to Modern Nations (MNverse) and Active members of the GA) 2 from the European Group, 1 from the Asian Group 1 from the South American Group, 1 from the North American Group and 1 from the African Group. A Nation cannot have more than 1 of its citizens as a Justice, at any one time. (III) Upon election, Members will commit themselves to cooperating with the Global Assembly, and to upholding the highest standards. (IV) The Secretary General and her members have the right to suspend any Member serving in the International Court that commits any violations to the law. The process of suspension requires a TWO-THIRDS MAJORITY vote by the Global Assembly. (V) Members who have been suspended will not be eligible for re-election. [CHAPTER 2, ARTICLE 1] (I) No judge of the GA International Court can exercise any Political or Administrative Function / engage in any other Professional Work. (II) No judge can act as Agent, Advocate or Counsel in any case. [CHAPTER 3, ARTICLE 1] (I) The Court has jurisdiction over legal disputes, so has the power to decide whether there is a dispute and, if so, whether the dispute is a LEGAL one. However, if the court determines that there is a genuine dispute, it should decline to hear the matter if the party involves a NON Global Assembly Member. The International Court could hear cases involving a member of the Global Assembly and a Nation that is officially trying to obtain Membership. (II) The International Court of Justice is the highest court under the jurisdiction of the Global Assembly. Rulings on international law are LEGALLY BINDING. Compliance with these measures is necessary to ensure the effectiveness of its decisions. (III) The Court is there to protect existing and current legal rights, to secure compliance with existing and current legal obligations, to afford concrete reparations if a wrong has been committed, and to legally uphold all binding resolutions passed by the Global Assembly. Therefore, the powers of prosecution are: (1) Imprisonment for a specified number of years, which may not exceed a maximum of 30 years; or (2) A term of life imprisonment, when justified by the extreme gravity of the crime and the individual circumstances of the convicted person. (3) A fine under the criteria provided by the Global Assembly. The Court may also establish a decision for the benefit of Victims of crime, and of the families. (3a) Fines will be a maximum of $5,000,000,000.00, anything above that requires unanimous agreement from all of the Justices of the International Court. (4) Arrest Warrants, whereby the persons concerned are wanted by International Jurisdictions for prosecution, or to serve a sentenced based on the court decision. (5) Economic Sanctions, concerning specific sectors of economic activity, including import or export bans on certain goods, investment bans, prohibitions on supplying certain services. (6) Diplomatic Sanctions, such as the interruption of diplomatic relations with the targeted country, or the coordinated recall of diplomatic representatives. (7) Freezing of assets belonging to listed persons or entities: all their assets are frozen, Persons and entities cannot make any funds available to those listed. (IV) All accused people, organizations, and sovereign entities shall be considered innocent until proven guilty. However, the International Court of Justice will be less accommodating to a State that fails to appear to answer claims that it has breached it's obligations to the Global Assembly. Justices will generally assume these allegations are true, provided there is "No evidence to the contrary". (V) The Court will establish principles for reparations to victims, including restitution, compensation and rehabilitation. The Court is empowered to determine the scope and extent of any damage, loss and injury to victims, and to order a convicted person to make specific reparation. [SIGNED BY] Mr. Gregory Figueroa
