I hope this missive finds you well.

With the past successes at purchasing military equipment and the collapse of Sparrow, the Kingdom of Poland finds itself at an awkward stage of finding a new purveyor of defense equipment for the 21st Century Modernization of Poland's armed forces. It is why we are reaching out to you now. We are seeking the purchase of several pieces of equipment for the PRAF and the PRN.

- 1x Supply-class Fast Combat Support Ship
- 4x KC-10 Extender Refueling Airplane
- 8x KC-130J Refueler
- 4x Ticonderoga-class Missile Cruisers

We feel the United States would be the best fit in becoming the primary supplier of Defense Equipment to the Kingdom of Poland and would be willing to sign a contract with the United States of America for you to supply 75% of Poland's equipment for the 21st Century Modernization of Poland's Armed Forces. We are also interested in purchasing certain VTOL aircraft to outfit on the Wasp-class recently purchased from your nation as well as our Dokdo-class vessel purchased from Korea.

Regretfully, the United States cannot sell (or issue a Limited Production License) for the Ticonderoga-class guided missile cruiser at this time. However, with that being said, the other three items at the quantities that you requested have been approved by the State Department, the Department of Defense, the White House, and Congress. If the Polish government submits a total of: $195,000,000.00 to the United States government, your government will have a valid Limited Production License to build these items until the end of August of 2004. Please inform me here once that payment has been made, or if you have any other questions.

Poland and the United States has a long history of working together and this is why Poland has decided to reach out to your government in an effort to continually modernize the Polish Royal Air Force. At this current juncture we are eager to purchase a significant number of aircraft that we have either previously purchased from the now defunct Sparrow Industries or from your nation itself, as well as inquire about purchasing additional aircraft for our Landing Helicopter Docks Amphibious Assault Ships.

In total these are the aircraft we are wishing to purchase:

If this is something that you are willing to accept, please respond with your confirmation of payment to the United States for the stated amount. This will serve as permission for the Kingdom of Poland to build these products under a Limited Production License.

Keep in mind that this is under the strict requirement that the liveries of these vehicles and vessels is distinctly different from that of the United States.​

I hope this message finds you well. I wanted to get a few points of clarification regarding our recent purchase from your nation.

First: In regards to the Ticonderoga-class cruiser, before we begin building these ships, we felt it necessary to inquire as to which version of the cruiser you are allowing us to build, if it is the version utilizing the twin VLS system or the older twin-arm Mk 26 Launcher systems.

Second: In regards to the Joint Light Tactical Vehicle; we currently do not have the capacity to construct these vehicles, we are not asking for a return of money but we feel we would be remiss if we did not inform you that we would not be building them currently.

Third: In regards to the LPL issued to us, we were wondering the time limit for the production, if there is one. We were hoping to break up the construction of the Ticonderogas and the Celestial-classes into at least two blocks in an effort to not overwhelm our ship building industry while they are also constructing civilian ships such as freighters.

I am writing you this message in regards to the recent attempt to purchase eleven VTOL aircraft known as the AV-8B Harrier II from your government. It has come to our attention that the intellectual property for this aircraft belongs to the British Government. We are currently not setting blame and merely contributing it to the rather large purchase order we made at the same time. We are requesting that we are reimbursed from decline of the sale that was at no fault of our own.

We look forward to doing further business with the United States State Department for future defense sales and will not let this affect our rather unblemished friendship thus far. It was an accident or an oversight and no blame belongs to anyone.

Mr. Dwarok,

I regret any inconvenience that this has caused your government. Attached to this message is a direct submission to your government from the Treasury for $350,000,000.00. I regret that this oversight occurred.

Platforms capable of having a VLS, let alone platforms that have one by default, are something that the United States rarely exports. I have spoken directly with the President on this matter. He informed me that he and the Secretary of Defense would be comfortable with Poland building the Ticonderoga's with the VLS systems, provided that the attached agreement is signed and agreed to by your government through the proper legal channels. I look forward to hearing what you think about the agreement.

Also, because of the trouble that we previously had regarding this sale, I have modified the LPL so that it is extended and does not expire until December 31st of 2008. I hope that this is acceptable to your government.​

American-Polish Agreement Regarding Vertical Launch Systems

CONTEXT


In 2007, the United States of America (also referred to as the United States or the American Government) agreed to an arms sale in which the Kingdom of Poland (also referred to as Poland or the Polish Government) could construct four Ticonderoga-class Cruisers and ten Celestial-class Frigates through a Limited Production License which expires after December 31, 2008. The United States did not specify what version of the Ticonderogas could be built, and the Polish government reached out for clarification before construction started. This Executive Agreement, if authorized and legally approved by the Polish Government, is authorized by the President of the United States pursuant to Executive Order 43-2.


ARTICLE 1
PRODUCTION OF VESSELS AND STRATEGIC WEAPONS REQUIREMENTS

1.1 Ticonderoga-class Cruisers - The Kingdom of Poland is authorized to build four Ticonderoga-class Cruisers.
a. The Polish Government may construct these Ticonderoga-class Cruisers to the specifications of the USS Normandy.
i. This includes the construction and utilization of two 61-cell Mk 41 vertical launch systems (VLS) on each of the four cruisers.
ii. This includes utilization of the Navy's "Linebacker Program" which modifies the standard AEGIS weapon system on the cruisers so that they can provide early, theater-level ballistic missile defense, especially regarding short and medium-range threats on each of the four cruisers.​
b. This agreement does not grant the Polish Government does not have the ability to construct Mk 41 vertical launch systems (VLS) on any other vessel besides the limited number of vessels specified in this agreement.​
c. The Polish Government will have access to weapons systems that can be launched from the Mk 41 VLS to utilize only for Ticonderoga-class Cruisers.​
1.2 Celestial-class Frigates - The Kingdom of Poland is authorized to build ten Celestial-class Cruisers.
a. The Polish Government may construct these Celestial-class Cruisers to the specifications of the USS Celestial.​
b. The Polish Government will have access to weapons systems that can be launched from the Mk 41 VLS to utilize only for Celestial-class Frigates.​
1.3 Strategic Weapons and WMD Requirements - The Kingdom of Poland will not retrofit the Ticonderoga-class Cruisers and Celestial-class Frigates obtained from this agreement to launch strategic weapons or weapons of mass destruction.
a. Poland will not launch intercontinental ballistic missiles (ICBMs) from the aforementioned cruisers or frigates that are obtained from this agreement, nor will the Poland transport such weapons on the aforementioned warships.
i. Tomahawk cruise missiles are not considered ICBMs for the sake of this agreement.​
b. Poland will not launch or carry weapons of mass destruction (radiological, biological, or chemical weapons) aboard the Ticonderoga-class Cruisers and Celestial-class Frigates obtained in this agreement, nor will Poland transport such weapons on the aforementioned warships.​


ARTICLE 2
PUBLIC DISCLOSURE AND PERMANENT COMPLIANCE REQUIREMENTS

2.1 Public Disclosure of Ownership - The Polish Government will notify the general public that it is constructing four Ticonderoga-class Cruisers and ten Celestial-class Frigates.
a. Upon initiation of construction, the Polish Government will issue a press release that it is constructing the aforementioned cruisers and frigates.​
b. Upon completion of vessel construction, the Polish Government will publicly launch the vessels and allow the press to document the event.​
c. If, for any reason, the hull numbers or vessel names of the aforementioned cruisers and frigates change in the future, the Polish Government will inform the United States Government and disclose it to the general public through a press release.​
2.2 Identification - The Polish Government will ensure that the Ticonderoga-class Cruisers and Celestial-class Frigates that it produces are visually distinct from those in the service of the United States.
a. The Polish Government will use liveries for the aforementioned cruisers and frigates that are distinct from the liveries used by the United States Navy and United States Coast Guard, and the Polish Government will fly the appropriate Polish flags/ensigns from these vessels in accordance with international law.​
b. The Kingdom of Poland agrees that it will never use the aforementioned cruisers and frigates to impersonate United States Navy or United States Coast Guard vessels.​


ARTICLE 3
DECOMMISSIONING OF VESSELS AND TERMINATION

3.1 Decommissioning of Cruisers and Frigates - If Poland decommissions these vessels, the Polish Government will only have the options of: scrapping the vessels covered in this agreement, or reselling them to the United States.
a. If the Polish Government decides to decommission the aforementioned cruisers and frigates covered in this agreement, then Poland may either scrap the ships themselves or sell them to the United States.
i. The United States reserves the right to reject purchasing the aforementioned cruisers and frigates, in which case Poland's only option would be to scrap the vessels.
ii. If the Polish Government decommissions the aforementioned cruisers and frigates, it must inform the United States, in writing, within one month of decommissioning.​
b. The Polish Government may not sell, lease, lend, donate, give, or surrender any of the Ticonderoga-class Cruisers or Celestial-class Frigates from this agreement to another nation, organization, or individual.​
c. To Terminate this agreement, it must be done in writing to the chief diplomat of the other country at least 24-hours before termination.
i. If the Kingdom of Poland terminates this agreement, then it must decommission and scrap all of the aforementioned cruisers and frigates that were produced in this agreement.​
ii. If the United States terminates this agreement, then Poland may continued to own and operate the aforementioned cruisers and frigates, but it will lose access to all American produced/owned missiles and ammunitions that can be fired from the VLS and other weapons systems onboard the aforementioned warships.​
