This law is designed to strengthen the Russian Federation’s institutional resilience during periods of heightened external threats, internal unrest, or emergencies. It grants the President and the Security Council expanded legal authority to act decisively in order to preserve national unity, protect state sovereignty, and ensure public order.
Article 1 – Declaration of National Emergency
a. The President, upon recommendation from the Security Council, may declare a National Stability Emergency in response to:
- Foreign aggression or hybrid warfare (cyberattacks, disinformation, economic sabotage)
- Large-scale civil unrest or regional separatist activity
- Pandemics, natural disasters, or strategic infrastructure failure
Article 2 – Expanded Presidential Powers
a. During an emergency period, the President may:
- Issue binding executive decrees with the force of federal law
- Postpone or modify elections at any level if deemed destabilizing
- Restrict public gatherings, demonstrations, and travel between regions
- Order internet blackouts, media restrictions, and foreign social media bans
- Deploy internal security forces without parliamentary approval
- Temporarily suspend specific rights outlined in the Constitution (e.g., privacy, mobility), subject to post-emergency judicial review
Article 3 – Role of the Security Council
a. The Security Council of the Russian Federation becomes the central command body during the emergency.
b. The Chairman of the Security Council (currently Dmitry Medvedev) assumes operational oversight of:
- Federal Ministries (Defense, Interior, Emergencies)
- National Guard and regional law enforcement
- Emergency media and communication policy
Article 4 – “Information Defense” Measures
a. The Federal Service for Supervision of Communications (Roskomnadzor) is empowered to:
- Shut down or block foreign media platforms
- Detain individuals disseminating “destabilizing or false information”
- Designate domestic or foreign media as “threat actors” during emergencies
Article 5 – Duration and Oversight
a. A National Stability Emergency may last up to 180 days, extendable by presidential decree.
b. The Federation Council (upper house of Parliament) must be informed within 72 hours of declaration.
c. Upon conclusion, the Constitutional Court will conduct a retroactive legal audit of emergency actions
Article 6 – Succession of Presidential Authority
a. In all circumstances where the President of the Russian Federation is unable to perform the duties of office due to incapacity, resignation, or death, the Chairman of the Security Council of the Russian Federation shall immediately assume the duties of Acting President until a new election is held in accordance with the Constitution.
b. This provision supersedes any conflicting language in Article 92 (3) of the Constitution or prior federal legislation specifying the Chairman of the Government (Prime Minister) as Acting President.
c. The Federation Council and Constitutional Court must be notified within 48 hours of the transfer of authority
