Dear Secretary Adams,

I hope this message finds you well. As the Thai Foreign Minister, I would like to express our commitment to strengthening our relationship with the United Kingdom, both economically and socially. As you may know, our two countries have a long history of collaboration, as evidenced by the Thai Student Exchange Program, which was initiated by Thailand and has fostered positive relationships between our young people.

Today, I am writing to you to propose a Tariff Reduction Agreement between our two nations. We believe that this agreement would be mutually beneficial, creating new opportunities for trade and investment and supporting the growth of our economies. By reducing tariffs on certain goods, we can help to lower the cost of doing business between our countries and promote greater prosperity for our people.

I would like to emphasize that this proposal is not made lightly. We have carefully considered the potential benefits and risks of such an agreement and believe that it is in the best interests of both Thailand and the United Kingdom. We are committed to working closely with your government to ensure that this agreement is negotiated fairly and equitably, taking into account the needs and concerns of both sides.

In addition, I would like to inform you that our Thai ambassador in London, Mr. Pisanu Suvanajata, is fully supportive of this proposal and is willing to work with your government to facilitate negotiations. We believe that our ambassador's experience and expertise will be a valuable asset in advancing this agreement.

I would also like to reaffirm our commitment to the values of free trade and open markets. Thank you for your email and your continued interest in bilateral relations between the United Kingdom and the Republic of Thailand. We consider the Student Exchange Program as a pivotal point in progressing relations but, thankfully, not the last of them. We're intrigued by your proposal for a Tariff Reduction Agreement and of course, would like to know more. At the same time, we would like to use it as an opportunity to discuss other plans and commitments for the future.

The Thai Ambassador in London, Pisanu Suvanajata, would prepare for the meeting the next day. Given her immense experience in foreign affairs, commercial, and military, she is always ready, eager, and supportive of any proposal that can strengthen the relationship between Thailand and the United Kingdom, allowing the opportunity for growth. She would be in her Foreign Ministry color suit with her golden name engraved. She is in her favorite brown suitcase with the Foreign Ministry emblem on it. She will transport using her office car to the Foreign Ministry building of the United Kingdom. From there, she would meet with the secretary to sign up for her attendance and wait for the allowance. She will enter the room of Lawrence Adams, Secretary of State for Foreign and Commonwealth Affairs. She will greet him in a westerner style.

Prior to the scheduled sit-down, Lawrence Adams spent the later part of the night reviewing the existing relationship between the UK and Thailand, conducting research on the current Foreign Policies that the Thai government appears to be following in order to make productive conversation between the two governments. The next morning, Adams sat in his office chair with a glass of water and a computer easily accessible. Reviewing his calendar, he knew the meeting with Thailand was coming close. The receptionist out the office would welcome the Thai Ambassador and escort him to the office of the Secretary of Foreign Affairs office, opening the door where Lawrence leaned over his desk and offered his hand. "It's a pleasure to meet you." he smiled. During that time, the receptionist had closed the door to allow the two to discuss in private.

Ambassador Pisanu Suvanajata, upon entering the room and shaking hands with Lawrence Adams, didn't waste any time getting to the point. "Mr. Adams, I have come today with a proposal that I believe will greatly benefit both our nations. Our governments have expressed interest in strengthening our economic ties, and I believe the best way to achieve that is through a bilateral agreement on tariff reductions."

Pisanu proceeded, "Our proposal includes a progressive reduction of tariffs on goods exchanged between Thailand and the UK. This would cover all goods traded between our countries, with certain exclusions and provisions that can be agreed upon by both parties. The goal is to stimulate economic growth and development for both our nations."

As she continued, Pisanu emphasized the importance of transparency and non-discrimination in implementing the agreement. She explained that the proposed agreement would have chapters covering the scope and coverage, tariff reduction, rules of origin, non-tariff barriers, dispute settlements, and entry into force and duration.

Pisanu went on to elaborate on the key features of each chapter, giving specific examples of how the agreement would benefit both countries. She highlighted the potential for increased trade, job creation, and technology transfer as some of the main advantages of the proposed agreement.

She also discussed the potential challenges that may arise during the implementation of the agreement, such as the need to adjust domestic laws and regulations to accommodate the new trade provisions. Pisanu assured Lawrence Adams that both countries would work closely to ensure a smooth transition and address any concerns that may arise.

As she spoke, she presented the document containing the full details of the proposal to Lawrence Adams. "We believe that this agreement will not only provide a framework for our economic cooperation but also serve as a solid foundation for future collaboration in various sectors. It is our hope that this agreement will pave the way for a more prosperous and fruitful relationship between Thailand and the United Kingdom."

Pisanu also mentioned the importance of engaging with the private sector and civil society in both countries to ensure that the benefits of the agreement are felt by all. "Our governments must work together to ensure that the implementation of this agreement is inclusive and benefits all segments of our societies."

Agreement on Tariffs Reduction between Thailand and the United Kingdom


Preamble

The Kingdom of Thailand (hereinafter referred to as "Thailand") and the United Kingdom of Great Britain and Northern Ireland (hereinafter referred to as "the UK") acknowledge the benefits of free trade and the imperative to stimulate economic growth and development. Both nations are committed to enhancing their economic ties through the reduction of tariffs and the promotion of trade in goods. This agreement aims to provide a framework for the progressive reduction of tariffs on goods exchanged between Thailand and the UK (hereinafter referred to as "the Parties").​

Chapter I
Scope and Coverage

Article 1: This agreement applies to all goods traded between Thailand and the UK, whether wholly or partially produced or acquired in the territories of either Party, as well as those that are re-exported from a third country.
Article 2: For this agreement, "goods" means any tangible and movable property, excluding electricity, and includes all kinds of products, commodities, raw materials, and manufactured and processed goods.
Article 3: This agreement shall not apply to:
a. goods traded between the parties that are subject to other bilateral or multilateral agreements or arrangements to which either party is a party;
b. goods traded between the parties that are covered by temporary or partial agreements or arrangements concluded between them before the entry into force of this agreement;
c. goods imported for personal use; and
d. goods imported for government use.​
Article 4: The Parties may agree to include or exclude specific goods or sectors from the scope of this agreement, subject to mutual agreement in writing.
Article 5: The parties shall ensure that the provisions of this agreement are implemented in a non-discriminatory manner and that they do not give rise to disguised restrictions on trade between the parties.​

Chapter II
Tariff Reduction

Article 6: The parties agree to progressively reduce and eliminate tariffs on all goods traded between them, per the following schedule:
a. Within 90 days of the entry into force of this agreement, the parties shall exchange tariff schedules setting out the base rates of duty for each good, as well as the schedule for tariff reductions.
b. The parties shall eliminate tariffs on at least 90% of the total number of tariff lines on all goods traded between them within five years of the entry into force of this agreement.
c. For the remaining 10% of tariff lines, the parties shall reduce the applied rates of duty to the base rate by an average of 50% within five years of the entry into force of this agreement.
d. The parties may agree to extend the timeline for tariff elimination or reduction for specific goods or sectors, subject to mutual agreement in writing.​
Article 7: The parties shall ensure that the tariff reductions under this agreement are implemented on a Most-Favored-Nation (MFN) basis.
Article 8: The parties shall cooperate and exchange information on the administration of customs procedures and the collection of tariffs to ensure the effective implementation of this agreement.
Article 9: The parties shall consult each other regularly on matters relating to the implementation of this agreement, and may review and amend the schedules of tariff reductions as necessary, subject to mutual agreement in writing.
Article 10: The parties shall ensure that any necessary adjustments to their domestic laws and regulations to give effect to this agreement are made promptly and transparently, per their respective legal and constitutional processes.
Article 11: This agreement shall not affect the right of either party to take measures for the protection of its essential security interests, apply measures, or apply anti-dumping or countervailing measures.
Article 12: The parties shall ensure that the provisions of this chapter are implemented in a non-discriminatory and transparent manner and that they do not give rise to disguised restrictions on trade between the parties.​

Chapter III
Rules of Origin

Article 13: For this agreement, goods traded between the parties shall qualify for preferential treatment under this agreement if they meet the requirements of the Rules of Origin set out in Annex I of this agreement.
Article 14: The Parties shall cooperate and exchange information on the administration of the Rules of Origin to ensure their effective implementation.
Article 15: The Parties may review and amend the Rules of Origin as necessary, subject to mutual agreement in writing.
Article 16: Each Party shall designate a competent authority responsible for the administration of the Rules of Origin and shall provide the other Party with the necessary information and assistance to enable the proper application of the Rules of Origin.
Article 17: The Parties shall establish a system for the verification of the origin of goods traded between them, per the procedures set out in Annex II of this agreement.
Article 18: The Parties shall ensure that the procedures for the verification of origin are conducted promptly, transparently, and per their respective laws and regulations.
Article 19: The Parties shall ensure that any necessary adjustments to their domestic laws and regulations to give effect to this article are made promptly and transparently, per their respective legal and constitutional processes.
Article 20: The Parties shall ensure that the provisions of this chapter are implemented in a non-discriminatory and transparent manner and that they do not give rise to disguised restrictions on trade between the Parties.

Chapter IV
Non-Tariff Barriers

Article 20: The Parties shall ensure that non-tariff measures do not create unnecessary barriers to trade between them, and shall work towards the elimination or reduction of non-tariff barriers to trade.
Article 21: For this agreement, non-tariff barriers to trade include, but are not limited to, technical regulations, standards, and conformity assessment procedures, as well as sanitary and phytosanitary measures.
Article 22: The Parties shall ensure that their non-tariff measures are transparent, non-discriminatory, and based on international standards and best practices.
Article 23: The Parties shall cooperate and exchange information on the development and implementation of non-tariff measures, and shall notify each other of any new or proposed measures that may affect trade between them, per the procedures set out in Annex III to this agreement.
Article 24: The Parties shall work towards the mutual recognition of conformity assessment procedures and standards, where appropriate, and shall consider the use of international standards and conformity assessment procedures as a means of reducing or eliminating non-tariff barriers to trade.
Article 25: The Parties shall establish a mechanism for the consultation and resolution of disputes relating to non-tariff barriers to trade, per the procedures set out in Annex IV of this agreement.
Article 26: The Parties shall ensure that any necessary adjustments to their domestic laws and regulations to give effect to this article are made promptly and transparently, per their respective legal and constitutional processes.
Article 27: The Parties shall ensure that the provisions of this chapter are implemented in a non-discriminatory and transparent manner and that they do not give rise to disguised restrictions on trade between the Parties.​

Chapter V
Dispute Settlements

Article 28: The Parties shall make every effort to resolve any dispute arising under this agreement through consultations and negotiations, to find a mutually satisfactory solution.
Article 29: If a dispute cannot be resolved through consultations and negotiations within 60 days of the initiation of the dispute, either Party may request the establishment of a dispute settlement panel, per the procedures set out in Annex V to this agreement.
Article 30: The dispute settlement panel shall be established promptly and shall make every effort to issue a report within 120 days of its establishment.
Article 31: The report of the dispute settlement panel shall be adopted by the Parties unless the Parties agree otherwise.
Article 32: If either Party fails to adopt the report of the dispute settlement panel, or if the dispute settlement panel finds that a Party has failed to comply with its obligations under this agreement, the complaining Party may take appropriate measures, including the suspension of tariff concessions or other obligations under this agreement, per the procedures set out in Annex E to this agreement.
Article 33: The Parties shall ensure that the procedures for the settlement of disputes are transparent, impartial, and per the rules and procedures of the WTO Dispute Settlement Understanding, to the extent that they do not conflict with the provisions of this agreement.
Article 34: The Parties shall make every effort to ensure that the dispute settlement procedures are expeditious, and shall cooperate in good faith to ensure that disputes are resolved on time.
Article 35: The Parties shall ensure that the provisions of this article are implemented in a non-discriminatory and transparent manner and that they do not give rise to disguised restrictions on trade between the Parties.​

Chapter VI
Entry into Force and Duration

Article 36: This agreement shall enter into force on the first day of the second month following the date on which the Parties have notified each other in writing that they have completed their respective internal procedures necessary for its entry into force.
Article 37: This agreement shall remain in force for a period of 10 years from the date of its entry into force, and shall be automatically renewed for successive periods of 5 years, unless either Party gives written notice to the other Party of its intention to terminate the agreement, at least 6 months before the end of the 10 years or any subsequent 5-year period.
Article 38: If either Party gives notice of its intention to terminate this agreement, the Parties shall enter into consultations within 30 days of the receipt of such notice, to find a mutually satisfactory solution. If no agreement is reached within 180 days of the commencement of consultations, this agreement shall terminate at the end of the 10 year or any subsequent 5-year period.
Article 39: Notwithstanding the termination of this agreement, any rights or obligations accrued under this agreement shall continue to be in force and effect after its termination, for a period of 10 years from the date of termination, unless the Parties agree otherwise.
Article 40: This agreement may be amended by mutual consent of the Parties, in writing. Any such amendment shall enter into force on the date specified in the agreement, or if no such date is specified, on the date on which the Parties have notified each other in writing that they have completed their respective internal procedures necessary for the amendment to enter into force.

ANNEX I

The Rules of Origin shall be based on the Harmonized System (HS) nomenclature, as well as any additional provisions agreed upon by the Parties, and shall include provisions for determining the origin of goods produced in whole or in part in the territories of the Parties, as well as provisions for determining the origin of goods that have undergone certain specified operations or processes.​

ANNEX II

The procedures for the verification of origin shall be based on the principles of transparency, predictability, and efficiency, and shall include provisions for the exchange of information between the Parties, as well as procedures for conducting verification visits, and provisions for the mutual recognition of the results of verification procedures conducted by the competent authorities of the Parties.​

ANNEX III

The notification procedures shall be based on the principles of transparency and timeliness and shall include provisions for the exchange of information between the Parties, as well as procedures for the review and assessment of new or proposed non-tariff measures.​

ANNEX IV

The dispute settlement procedures shall be based on the principles of transparency, predictability, and fairness, and shall include provisions for the exchange of information between the Parties, as well as procedures for the consultation and mediation of disputes, and provisions for the establishment of an arbitral panel if a dispute cannot be resolved through consultation and mediation.​

ANNEX V

The dispute settlement procedures shall be based on the principles of transparency, predictability, and fairness, and shall include provisions for the exchange of information between the Parties, as well as procedures for the establishment of a dispute settlement panel, the conduct of the proceedings before the panel, and the adoption and implementation of the report of the panel. The procedures shall also include provisions for the suspension of tariff concessions or other obligations under this agreement, if a Party fails to adopt the report of the dispute settlement panel, or fails to comply with its obligations under this agreement.​

Lawrence retained his silence to allow the Thai Ambassador to deliver his full proposal without any interruption, a pen in his hand to take notes based on what was said and no doubt much to consider. Adams nodded his head intermittently to indicate his attentiveness before eventually reaching out and receiving the proposed document namely the "Agreement on Tariffs Reduction between Thailand and the United Kingdom". Before reading into the proposal, Lawrence spoke up:

"It's a pleasure to hear of your governments vested interest in developing relations between the UK and Thailand and is certainly a welcome one. Although interaction has been somewhat limited, we've seen progress in the form of the Student Exchange Program and the proposal you've delivered today. Thailand is becoming, if not already, the key UK partner in Asia and what you've said would do nothing less of develop that further."

Lawrence paused as he begun to work through the agreement, article by article. A little bit of nodding as he read through some of the elements and a couple 'hmm' indications suggest he had some areas to discuss.

"It comes across as a very thought out agreement, one I can't see the government objecting in any capacity, really. There is one amendment I'd like to see, specifically more from an administrative point of view. Article 37 suggests a 10 year period but I'd like to see that halved and have it in force for a 5-year period instead. Naturally, we're happy for this to automatically renew with each five year period and then after, perhaps we could look into extending it. It's just that initially, we'd like this to be five-years if this is acceptable for yourselves?"

She paused briefly, her eyes conveying a deep sense of purpose, before continuing, "In light of this objective, I am confident that my government will be amenable to the amendment you have suggested for Article 37. Reducing the initial period to five years, with the option for automatic renewal, is indeed an acceptable proposal."

The Thai Ambassador's voice then took on a tone of solemn determination, as she addressed the necessary adjustments to Articles 38 and 39, "Furthermore, I will personally ensure that Articles 38 and 39 are amended accordingly, to maintain consistency with the revised Article 37. This will ensure that our agreement remains harmonious and well-structured, reflecting the cooperation and commitment between our two countries." Ambassador Pisanu Suvanajata's unwavering resolve and willingness to accommodate the concerns of the United Kingdom demonstrated her deep understanding of the delicate balance required in international diplomacy. She remained steadfast in her mission to strengthen the relationship between Thailand and the United Kingdom, fully aware of the immense responsibility she carried in her role as an ambassador.

As she concluded her response, her gaze met Lawrence Adams', her eyes brimming with sincerity and conviction, "Mr. Adams, it is my fervent hope that these amendments will solidify the foundation of trust and cooperation between our nations, paving the way for a brighter and more prosperous future for our people."

Adams nodded with a gentle smile "Thank you, the amendment to these specific articles to reduce the time is, as mentioned, out of caution. Once the amendments are made, I would certainly be looking to give the sign off to put such agreement in force. Naturally, it serves as one of hopefully many discussions and agreements that can be put in place to bring our countries closer together." he concluded, overall, the agreement was sound and the reduction of the time would only serve as a better opportunity to communicate more often -- meaning a 10 year gap could be considered quite lengthy in early stages of relations. Nonetheless, with such a meeting take place, Lawrence would be sure to benefit further and learn about his Thai counterparts more. He continued to speak:

"You, and by extension the Thai Government appear to be very progressive in the world stage. Calling the Global Assembly to discuss Congo was a surprising decision, especially so late into the conflict. Not that it shouldn't happen, but may I inquire as to whether something had changed within your government to prompt such a resolution? It appears that your Foreign Policy is expanding to... um, take a more prominent place in international politics. Is that the case?" he asked with curiosity, but also as a conversation started to better understand how the government he could be working closer with... operates.

His gaze never wavered from Lawrence's, as he sought to convey the depth of his convictions and the sincerity of his nation's intentions. "It is indeed true, Mr. Adams, that we seek to take a more prominent place in international politics. We understand that with this expanded role comes greater responsibility, and we are prepared to shoulder that burden in the pursuit of global peace, stability, and prosperity."

Lawrence sat in quietness, listening to the words that left the mouth of his guest. Feedback from other visits had all led been around that delegates from Thailand are obviously very passionate about their wording, perhaps not the most normal of politicians, especially compared to Western standards. The Secretary of Foreign Affairs focused on honing on any response that could be considered a solid answer for what he was after, was the Thai Government interested in becoming a world power? Yes - and to what extent they wanted their place to be in an international level. It was becoming apparently by recent actions that a soft power was their goal, and definitely achievable to represent Asia given the lack of contenders in the region. He spoke, rather promptly once his guest had finished his answer.

"With these goals in mind, to gain international influence, I'd like to ask what you consider a threat to achieving these goals? What are the challenges your government faces? Internationally and regionally, especially in Asia. I'm curious to hear your current policies with the likes of China, Russia, the USA, Sweden. Are there any specific that you've had... negative experiences with thus far?"

He was straight to the point, hoping to establish a better understanding of the Thai's position with other countries and how that may impact the United Kingdom, short or long term. He continued to speak, "As you may also know, the UK are due to have a General Election next year which will see the end of the current government due to the resignation of Prime Minister Andrews. Between us... I've put my name in the running to lead the Conservative Party and would like to strengthen the relationship with Thailand and providing I can enter office as Prime Minister, I would be looking to expand the UK to have a more global reach in all aspects. Economically, Politically and Militarily. One area we've not yet covered is Military and whether, of course if I'm able to enter office, Thailand would be open to hosting a UK Military base?"

He thought carefully about his response, while the idea of a deeper relationship with Thailand could be beneficial, he saw genuine risk with their long-term plans. Realistically, Thailand was a competitor. Equally, relations and agreements are needed to keep the peace and promote cooperation despite end goals. Lawrence nodded throughout the response given by his guest, the focus of his response surrounding the military base: "I would certainly be open to the idea of a Thai military base in the UK but like yourself, it's not something I can make the decision on individually. We currently have an agreement with the United States which resulted in both parties having shared military facilities with elements of a defence agreement. Unfortunately, this does rely on me taking over as Prime Minister at the end of Andrew Evans' time.

Speaking of more current affairs, you spoke of Russia as the major supplier for your armed forces, for now? What market are you looking to invest in to supply your military?" While having no personal stake in Nexus, Lawrence knew that getting customers on-board would only support the UKs economy further but also work to improve the standing of European defence markets, something often overlooked.. He continued: "The UK have extremely close ties with Nexus' who are our preferred supplier and our own military industry are able to provide some of the most up to date technologies for the problems the work faces -- most of which has been used in the conflict with Turkey only a couple of years ago. Naturally most countries aim for Russia or American defence companies but often overlook the broad European market."

Lawrence retained his silence, knowing the benefits of introducing more business for Nexus and how it could support employment for those in the UK whilst offering Thailand new equipment alternatives. Naturally, with the sudden tensions over the last few days, that may not be so easy to attain. Either way, relations between the UK and Thailand definitely needed to progress a little more cautiously. "Russian equipment is certainly fine, from our experience, it's cheap and easy to build in larger quantities. This market doesn't work well for the United Kingdom due to the size of our forces, so we opt for quality over quantity. Depending on your own defence doctrine, Nexus or other western-based suppliers may be worth checking out. It would certainly introduce new elements for working together closer." he concluded.

It took some moments of thought to determine his next step, but it couldn't be avoided. Despite the strong-growing relations between the UK and Thailand, Lawrence had to ask the question. "I have to ask... away from our main topic. The Thai Navy seemed, for lack of better word, desperate to deploy into Europe. Not just a couple ships, but almost a full fleet of combat-based vessels, to a continent that has very specific standards and processes. I understand the narrative was peacekeeping but I think it was more than that. What was the main, or secondary purposes to deploying such a large number of ships?

Is it related to what you had already mentioned earlier in this conversation? The focus of world power? Having the ability to deploy that many ships, and to deploy to the most active region where other world powers are prominent. It's hard to see it as just a peacekeeping exercise." His tone of voice was rather standard, he didn't sound concerned or distasteful at the matter, but more curious. He was also rather blunt about how he asked it to get to his point, yet remained friendly. Relations with Thailand needed to continue but he needed to understand their goal further. Especially for such a rapid escalation.

The British Delegate sat in silence, blinking a few times as the Thai representative appeared flustered. It felt like everything that was said, was from panic or confusion as to the situation the Thai Navy had put itself into. Perhaps he was right, it was miscommunication but Lawrence didn't seem to receive any concrete answers - it was almost like a political doing a General Election speech, talk fast, say lots and the general public brush it off and only hear what they desire. Rather than addressing it further, he simply nodded. At this point it was either complete disarray with the Navy or that this particular Ambassador had very little information about it altogether. "Understood" Lawrence managed to say, unfortunate he had no real information to take back regarding the situation but it wasn't something he was that vested in, especially because the escalation had ceased.

"Fortunately, I think it's possible to put the whole situation behind us and focus on preventative measures to ensure such scenarios don't re-occur in future but I think that covers my questions and points I would have liked to raise. Is there anything else you'd like to bring to the table to discuss?" he concluded, having crossed off his key agendas and overall, finding the discussions positive and a step forward for UK-Thai relations.
