TRANSFER OF MILITARY GRADE AIRCRAFTS |

This certification certifies that the Republic of Korea Air Force has transferred into the care of the United States of America three Boeing E-767 AWACS aircrafts. The aforementioned aircrafts were purchased under the terms and conditions of the American-Korean Cooperative Arms Agreement (1997). Noting said agreement and its terms and provisions pertaining to the re-selling or purchased goods and following with its spirits, the Republic of Korea shall uphold its commitments under the American-Korean Cooperative Arms Agreement.
The Republic of Korea Ministry of Economy and Finance shall attest, as per the service and maintenance records of the ROK Air Force's 1919th Intelligence & Reconnaissance Squadron that the three transferred aircrafts have not been used in combat situations or conduct operations against a foreign entity. Noting that the definition of a foreign entity in this case shall include: state, non-state, and intergovernmental actors. This certification is attested to by the transferring party, the Republic of Korea. This certification with the acceptation of aircrafts the receiving party, the United States, shall be considered acceptation of the letters of service and maintenance unless otherwise noted within 30 days of receiving the aircrafts.
The ROK Air Force in its due diligence have completed maintenance necessary to keep the aircrafts fly-worthy and shall provide maintenance reports to the US Air Force as part of the swap of aircrafts. The ROK Air Force shall fly all three Boeing E-767 AWACS to the United States Andersen Air Force Base in Guam. Noting such handover shall be done within the agreed terms of the respect aerial branches of the parties armed forces. The Republic of Korea transfers these aircrafts understanding no international instruments exist regulating the sale and transfer of unconventional weapons. Korea notes its high standard for the export and sale of weapons as outlined by Executive Order titled "Strengthening the National Defense Companies for the Republic of Korea". Acknowledging the American-Korean Cooperative Arms Agreement as the guiding instrument in the sale, re-sell, and transfer of items purchased under its terms and conditions and relevant clauses. The Republic of Korea notes that transferred weapons should not be re-sold to the Occupied South African Government, the State of Israel, the Serbian Government, and Ukraine due to Korean export policies regarding these entities.
