The Chief Justice requested to the Royal Marechaussee that no one but the justices and court staff were allowed into the chamber.

The Royal Netherlands Marechaussee would escort out all those not authorised to be in the chambers at that time, they would proceed to maintain security inside and outside the building and ensure that the Justices could proceed with their hearing in a private manner.

The Dutch Justice Anne Cuijpers would arrive and take her place after greeting her colleagues, she would then patiently await the arrival of the last Justice while reading the case file.

Seeing that everyone has arrived, Chief Justice Rolfe Olhouser asked the Royal Marechaussee to allow the defendants, the plaintiffs, witnesses, and the staff for those parties to enter the chamber. Outside of that, there were to be no spectators.

The Brazilian Delegation would regret to inform the International Court of Justice that Juan DeSilva is in Washington D.c. at the moment and it will take some time for him to arrive in front of this, a different representative, Mr. DeSilva's lawyer, Pablo Valenzuela, as stated he will answer for his client. He then coughs several times without excusing himself in front of the esteemed panel.

"As for teh first charge, Threatening a French Diplomat? The same country that says its own streets are dangerous for them to extract our diplomats from France? I think this is the other way around."

"Charge #2 a Film Video? Same. I actually called down the strike to allow the French diplomats to leave. France again is not even reciprocating here. Maybe they should be on trial?

As far as File#3: Yes, a meeting took place. I can conform that. Just as I can conform that my embassy in Berlin has been surrounded by over several hundred police officers. Without proper warning.

Guess you guys will be having more of these trials, eh?"

Olhouser cut Mister Valenzuela off as he begin to speak. "Excuse me, counselor. We need to have Minister DeSilva present before we can proceed. I apologize for the short notice. We have made a few changes to the court and sadly there was a learning curve with our system of summons. I would be willing to grant a twenty-four hour recess for Minister DeSilva to arrive here to the court, if that would help?"

"I will try. But with the earthquake in California who knows how long it will take for my colleagues to get here.

But while we are here, why not comment on my initial rebuttals to the charges."

"Counselor, we are not in session yet and the official record has not been started yet because we would like the defendant, Minister DeSilva, to be here. However, since we are discussing the status of the defendant, I'd like to ask the court reporter to begin the record with the counselor's previous comments. Now, while I am happy that you have made yourself present, we need Minister DeSilva himself to be here. As I understand, the earthquake occurred in Los Angeles, which is on the West Coast, and Washington D.C. is several thousand miles away on the other side of the country. Are you claiming that flights out of Washington D.C. are not possible, or that Minister DeSilva is currently assisting the American government in some way?" Olhouser sat back in his chair and folded his hands on the bench as he waited for a response from the Minister's attorney.

"We have been given little information about travel in the US currently. With many flights having to be cancelled in the US, it seems the whole airline industry is a bit of a flux. It seems as though even though the Americans were well aware of a possibly potentially huge earthquake, they emergence response was not quite as quick or orderly as possible.

We would like to make our way to the Hague, but given the amount of protests on the way into Washington by people burning Brazilian flags and tossing things at our vehicles, perhaps it is not the best time to ask the US for any special favors at the moment. In getting us back to the airport.

"I may be wrong," the Chief Justice said as he looked over at the American justice, "but I don't think flights out of Washington D.C. to Europe should be affected by the earthquake in California. If there is a legitimate safety concern, however, that would be grounds for us to call a recess until Minister DeSilva can make himself present. If protests outside of the embassy are the only thing keeping the Minister from coming here, I would be happy to have the court contact the American State Department and request for Minister DeSilva to be given safe passage to the airport so that he can attend this proceeding. Do you think that would be acceptable, counselor?" Olhouser said.

"Perhaps that could help, contacting the Americans. As long as they can get back to the airport and their jet they should be fine getting to the Hague.

And dow, that we are here and have some free time and since everything is off the record, perhaps we could discuss the chaos outside the Brazilian embassy in Berlin. We may be right back here for that diplomatic fiasco."

Olhouser remained in his seat since this probably wouldn't take too long.

The Olhouser instructed some court officials to contact the United States State Department. These court officials explained the situation and requested that the American government provide safe passage for the Brazilian diplomats to the airport so that they could show up to the International Court of Justice.

Olhouser wrote on the same piece of paper, "If the Americans can get him safely to the airport? Twenty-four hours from then. I'll buy a first-class ticket for him myself if it gets this moving along." He passed it back to the Vietnamese justice. He did so privately.
