On behalf of the Imperial Korean Air Force, I am pleased to inform you that your submission regarding the Airbus A310 MRTT Tender has been reviewed and accepted. We are confident that this aircraft will meet our operational requirements and provide a valuable enhancement to our capabilities.

Dear Minister Lee,

Thank you for choosing the Airbus A310 MRTT. We are confident that this platform will fully meet your operational requirements.

In order to initiate the application process for the required arms export license, we must first have a duly signed sales contract. For your review, I have attached a draft version of the agreement.

DEFENCE ARMS SALES CONTRACT

Between the French Arms Export Office and the Government of the Korean Empire

PREAMBLE

This Defence Arms Sales Contract (“Contract”) is entered into by and between:

The French Arms Export Office (hereinafter referred to as the “Seller”), and

The Government of the Republic of Korea, represented by its Ministry of Defense (hereinafter referred to as the “Buyer”).

Collectively referred to as the “Parties.”

The Parties, recognising their mutual commitment to defence cooperation, strategic partnership, and adherence to international law, hereby agree as follows:

ARTICLE 1 – SUBJECT OF THE CONTRACT

The Seller agrees to sell, and the Buyer agrees to purchase, the following defence equipment and services:

NUMBER (X) Airbus A310 MRTT Multi-Role Tanker Transport.

ARTICLE 2 – DELIVERY SCHEDULE

Delivery shall be made in one (1) batch according to the schedule agreed by the Parties.

The estimated delivery timeline is [insert months/years].

ARTICLE 3 – PRICE AND PAYMENT TERMS

The total contract value is FF [amount].

Payments shall be made in French francs to designated accounts of the Seller in a single installments.

Payments shall be made to the following designated account: FR39 3000 1007 9132 136 5427 952.

Payments shall be made by wire transfer and are non-refundable.

ARTICLE 4 – TECHNICAL ASSISTANCE

The Seller shall provide:

Technical documentation in French an English.

ARTICLE 5 – QUALITY ASSURANCE

The Seller warrants that the equipment delivered shall be new, free from defects, and conform to specifications.

ARTICLE 6 – END-USE AND NON-TRANSFER

The Buyer agrees that the purchased arms shall be used exclusively by the Armed Forces of the Korean Empire.

The Buyer shall not transfer, resell, lease, or otherwise dispose of the arms to third parties without the prior written consent of the Minister of Defence of the French Republic.

ARTICLE 7 – CONFIDENTIALITY

All information, data, and documents exchanged under this Contract shall be treated as classified and confidential, and shall not be disclosed to third parties without prior written consent of the other Party.

ARTICLE 8 – EXPORT CONTROL AND COMPLIANCE

This Contract is subject to applicable French national legislation on arms exports and international treaties.

Delivery is contingent upon obtaining necessary export license. The Seller shall facilitate the request for an export license on behalf of the Buyer.

ARTICLE 9 – FORCE MAJEURE

Neither Party shall be held liable for delays or failures in performance caused by events beyond their control, including but not limited to war, natural disasters, embargoes, or government restrictions.

ARTICLE 10 – GOVERNING LAW AND DISPUTE RESOLUTION

This Contract shall be governed by the laws of France unless otherwise agreed.

Any dispute arising out of or in connection with this Contract shall be settled by negotiations.

ARTICLE 11 – FINAL PROVISIONS

This Contract constitutes the entire agreement between the Parties.

Any amendments must be made in writing and signed by authorised representatives of both Parties.

This Contract shall enter into force upon signature by both Parties.

As outlined in the document, the execution of the contract, and thus both the payment and production, is expressly contingent upon the granting of the export license, thereby safeguarding both Parties in the event of a denial.

At this stage, we kindly request confirmation of the number of aircraft you wish to procure. Should you wish to include additional aircraft as options, doing so now would streamline any future acquisitions by allowing them to fall under the same export license. Once we receive this confirmation, we will promptly amend the contract and provide a corresponding cost as well as the production and delivery timeline.

We look forward to your reply and once again thank you for your confidence in selecting the Airbus A310 MRTT.
