Global Assembly Resolution on the Syrian Crisis

The Global Assembly,

Reaffirming
its commitment to the sovereignty, independence, unity, and territorial integrity of Syria, and to the purposes and principles of the Charter of the Global Assembly,

Expressing grave concern at the deterioration of the situation in Syria, and profound regret at the loss of life and human suffering caused by the conflict,

Recognizing the urgent need for a comprehensive and inclusive political solution that respects the aspirations of the Syrian people,

Emphasizing the importance of the Kurdish people's right to self-governance within a democratic framework and their crucial role in maintaining stability and combating extremism,

Noting the involvement of external actors in the Syrian conflict and the risk of exploitation for strategic gains,

Welcoming the efforts of the international community to support a political transition and stabilization in Syria,

1. Demands an immediate cessation of hostilities by all parties involved in the Syrian conflict and urges them to engage in meaningful negotiations towards a political solution,
2. Calls for the deployment of an independent and neutral peacekeeping force, led by European nations, to stabilize contested and northern regions, protect civilians, and ensure the safety and security of all Syrian people,
3. Supports the establishment of a political framework that upholds Kurdish rights and Syrian sovereignty, ensuring that all voices are heard in shaping Syria's future,
4. Encourages the international community to provide humanitarian assistance to the Syrian people and support the efforts of neighboring countries in hosting Syrian refugees,
5. Urges all parties to facilitate the safe and unhindered delivery of humanitarian assistance to those in need, in accordance with international humanitarian law,
6. Stresses the importance of accountability for violations of international humanitarian law and human rights abuses committed in Syria,
7. Calls upon all parties to cooperate fully with the Global Assembly and relevant international organizations in the implementation of this resolution,
8. Decides to remain actively seized of the matter and to review the implementation of this resolution within six months.

Dear Mr President,

On behalf of the Secretary-General, I acknowledge receipt of the draft resolution.

The Office of Legal Affairs advises Member States to ensure draft resolutions comply with international law and meet standards for effective implementation. Given that this draft resolution invokes the Global Assembly's authority under CHAPTER IX of its Charter, it is crucial that the resolution is clear and precise.

The Office of Legal Affairs recommends the Portuguese delegation consider the following amendments to the operative section:

1. Calls upon all parties in Syria to immediately cease all armed violence in all its forms;
2. Decides to establish a Global Assembly Peacekeeping Mission in Syria (GAPMS) under the command of a Force Commander, compromising an initial deployment of up to ### armed military personnel as well as an appropriate civilian component as required by the Mission to fulfil its mandate, and decides further that the Mission shall be deployed expeditiously subject to <DESCRIBE THE CONDITIONS UNDER WHICH THE PEACEKEEPING FORCE IS TO BE DEPLOYED>;
3. Decides also that the mandate of the Mission shall be to <DESCRIBE THE MISSION PARAMETERS>;
4. Requests that the Secretary-General and the Syrian government without delay conclude a Status of Mission Agreement (SOMA);
5. Calls upon all parties to guarantee the safety of the Mission’s personnel without prejudice to its freedom of movement and access;
6. Requests the Secretary-General to report immediately to the Assembly any obstructions to the effective operation of the Mission by any party;
7. Invites all Member States to consider making appropriate contributions to the Mission as requested by the Secretary-General;
8. Expresses its intention to assess the implementation of this resolution and to consider further steps as appropriate;
9. Decides to remain seized on the matter.

The highlighted sections require political decisions from the submitter.

Given the urgency of the situation, the Secretary-General use their powers under the Provisional Rules of Procedure of the Assembly to call for an Emergency Session. I kindly request your prompt response indicating whether the Portuguese delegation wishes to submit an amended draft resolution or proceed with the original submission. This will enable me to convey the Office of Legal Affairs' position to the Secretary-General.

Annex: Revised Draft Resolution on the Establishment of a Global Assembly Peacekeeping Mission in Syria (GAPMS)

The Global Assembly,

Recalling
its primary responsibility for the maintenance of international peace and security,

Reaffirming its commitment to the sovereignty, territorial integrity, and political independence of the Syrian Arab Republic,

Expressing grave concern at the ongoing violence and humanitarian crisis in Syria,

1. Calls upon all parties in Syria to immediately cease all armed violence in all its forms and engage in peaceful dialogue to resolve the conflict;

2. Decides to establish, a Global Assembly Peacekeeping Mission in Syria (GAPMS) for an initial period of twelve months, under the command of a Force Commander appointed by the Secretary-General, comprising up to 5,000 military personnel and an appropriate civilian component;

3. Authorizes GAPMS to use all necessary means to carry out its mandate, including:
  • Ensuring the protection of civilians under imminent threat of physical violence.
  • Facilitating the conditions for free and fair elections in Syria, including providing security and logistical support for electoral processes.
  • Establishing and maintaining a semi-demilitarized zone between the Kurdish Autonomous territory and the rest of Syrian territory to reduce tensions and prevent conflict.
4. Requests the Secretary-General to conclude a Status of Mission Agreement (SOMA) with the Syrian government, and to report to the Assembly on the implementation of this resolution;

5. Calls upon all parties to cooperate fully with GAPMS, ensuring the safety and freedom of movement of its personnel;

6. Requests Member States to provide the necessary military and civilian personnel, as well as financial and logistical support, to enable GAPMS to fulfill its mandate;

7. Decides to review the mandate of GAPMS in six months, based on the Secretary-General's report on the situation in Syria;

8. Expresses its intention to remain actively seized of the matter.

Rules of Engagement for GAPMS:

  • Self-Defense: GAPMS personnel are authorized to use force in self-defense and defense of the mandate, in accordance with international law.
  • Protection of Civilians: GAPMS is authorized to protect civilians under threat of physical violence, with the use of force as a last resort.
  • Freedom of Movement: GAPMS shall have the right to freedom of movement and access throughout Syria, as required by the mandate.
  • Coordination with Local Authorities: GAPMS shall coordinate its activities with local authorities and other international actors on the ground to ensure the effective implementation of its mandate.
  • Support for Elections: GAPMS shall provide security and logistical support to facilitate free and fair elections in Syria.
  • Semi-Demilitarized Zone: GAPMS shall establish and maintain a semi-demilitarized zone between the Kurdish Autonomous territory and the rest of Syrian territory, monitoring compliance and mediating disputes as necessary.
This revised draft resolution aims to provide a clear and actionable framework for the establishment and operation of GAPMS, in line with the recommendations of the Office of Legal Affairs and the principles of the Global Assembly.
