2.2 The Gross Amount shall be paid in two equal quarterly payments, as per the agreed finance plan.

2.3 The first payment of $1,227,771,253.8 shall be made within 30 days of the Effective Date.

2.4 The second payment of $1,227,771,253.8 shall be made within 3 months of the first payment.

2.5 Ownership of the goods shall remain with the Seller until the Gross Amount is fully paid by the Buyer.

2.6 Failure to make timely payments may result in penalties or delays in the delivery of the Goods.
3. DELIVERIES

4.1 The Seller warrants that, at the time of delivery, the goods shall conform to the agreed specifications and be free from defects in materials and workmanship.

4. LIABILITY

2. FINANCIAL PLAN

2.1 The total gross amount payable by the Buyer for the goods mentioned in Section 1.1 shall be $2,455,542,507.60 (hereinafter referred to as the "Gross Amount").

2.2 The Gross Amount shall be paid in one payment, as per the agreed finance plan.

2.3 The payment of $2,455,542,507.60 shall be made within 30 days of the Effective Date.

2.4 Ownership of the goods shall remain with the Seller until the Gross Amount is fully paid by the Buyer.

2.5 Failure to make timely payments may result in penalties or delays in the delivery of the Goods.
3. DELIVERIES

4.1 The Seller warrants that, at the time of delivery, the goods shall conform to the agreed specifications and be free from defects in materials and workmanship.

4.2 The Seller shall begin delivery of Goods to the Buyer once the initial payment has been received.

4.3 Failure to make timely deliveries may result in penalties.
4. LIABILITY

7.1 The Seller's liability under this Agreement shall be limited to the Gross Amount paid by the Buyer for the Goods.

7.2 The Seller shall not be liable for any indirect, consequential, or incidental damages arising out of or in connection with the Agreement, including but not limited to loss of profits, loss of data, or loss of use.​

This Agreement constitutes the entire understanding between the parties with respect to the subject matter hereof and supersedes all prior discussions, negotiations, and agreements, whether oral or written.

This Contract (hereinafter referred to as the "Agreement") is entered into on APRIL 2002 (the "Effective Date"), between Nexus Defence (hereinafter referred to as the "Seller") and the Kingdom of the Netherlands (hereinafter referred to as the "Buyer").

WHEREAS, the Buyer intends to procure military vehicles as part of the Defence Infantry Vehicle Fighting Programme; and

WHEREAS, the Seller possesses the necessary capabilities and resources to supply the required vehicles and associated services;

NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the parties agree as follows:

1. DESCRIPTION OF GOODS

1.1 The Seller agrees to sell, and the Buyer agrees to purchase, the following goods:

a) 225 units of Combat Vehicle 90s (hereinafter referred to as "CV90s"), which are combat vehicles designed for military operations.

b) 45 units of Combat Vehicle 90 FCVs (hereinafter referred to as "CV90 FCVs"), which are combat vehicles equipped with fire control systems and designed for military operations.​

1.2 The Seller shall provide parts to the Buyer for the CV90s and CV90 FCVs, which shall allow the facilitation of regular inspections, servicing, repairs, and technical support.
