As decided by the Constitutional Assembly of 30 September 2003, the Transitional Government of the Republic of China has been appointed as the holder of all executive, legislative and judicial power within the territory of the Republic of China pending the election of the President of the Republic of China, Congress of the Republic of China (also known as the Legislative Yuan), and the appointment of the Executive Yuan, Supreme Court of the Republic of China (also known as the Judicial Yuan), the Control Yuan, and the Examination Yuan. Its powers have been constrained by the Constitutional Assembly to prevent abuse of power within the few months until elections have taken place. Upon election of the President of China, executive powers will pass to them and the members of the Executive Yuan nominated by them and approved by the Senate, upon election of the Congress it will inherit all legislative powers and temporarily hold the powers of the Supreme Court, Control Yuan, and Examination Yuan until the members of these bodies have been nominated by the President and approved by the Senate. The Chairperson of the Transitional Government also serves as Acting President of the Republic of China. Its role as a caretaker government is reflected in the Ministries being established being restricted to the bare minimum to begin the process of Chinese restoration and will almost certainly increase significantly following elections.
