"I agree that this is not the time to debate the situation in the Middle East. We've talked about a lot of things thus our meeting has gone on for a long time. If the session continues, it has the potential to harm our country's philosophy. Nonetheless, as Korea stated, the primary purpose of the ASEAN Plus model is trade and commerce. You can ask ASEAN members to send a military attaché to discuss the situation when we finished setting up the ASEAN. Back then, we tried to build ASEAN corporate in the military to defend ourselves from communists.

As Korea suggested, we should draft a formal treaty. All I want to know is if anyone wants to talk about something other than military matters."

"I understand that the Australian Government has had deficiencies in their foreign office for several months and failed to recognized several actions that provoked and exposed tensions in the region. Your failures perhaps to the Israeli-backed regime in the West Bank which was both apartheid and racist in nature, the Judea regime, and the continued indirect rule of Palestine through the provisions of the Zones B & C of the Oslo Accords, and until recently, not recognizing a Palestinian Government. Perhaps the Australian Government has also failed to taken note of Israeli's provocations on the Gaza Strip? Until a Palestinian State is fully independent and its rights respected, until the Palestinian people are recognized and their rights respected, Korea will not recognize the Israeli Regime. Is the Australian Representative's desire to make ASEAN their tool to export foreign policy objectives? If this is the case, I believe that Australia has severely misunderstood the purpose of this forum.

Now. Back to the matters which are of all our concern, the development of trade and economic relations through a formalized treaty. We hope that a draft can be completed, and are curious to know if the ASEAN members have any previous agreements that they can share with us so that we can use them as a base model."

We can cut the Southeast in the name and change it to the treaty of amity and cooperation in East Asia and the Pacific. Or maybe just Asia. We need to have a clear and deep Purpose and Principles chapter. We can start by editing it and purpose it to review if any detail needs to be added. We need to work together on the draft."

"Yes, we believe that the Treaty of Amity and Cooperation would be a useful base model. One which we can edit and expand participants and include clauses on the existing members and added members, providing an automatic clause for the original members of ASEAN to join with a formal letter of intent from their governments and adding provisions for all members to vote and expand the membership of the association.

Would we want to sign a Trade Agreement separately during this session, or, would we prefer to postpone trade talks and discuss them in depth at a later date. I believe for efficiency purposes, we should focus on the Treaty of Amity and Cooperation and move forward from there on addressing other aspects at a later date."

"The Republic of Korea proposes the following language for the ASEAN forum to use. I hope that it will be useful for the association and be the building blocks by which the leadership of Vietnam may use to spearhead the Asian Century. I am most hopeful and reassured in Vietnam's efforts and actions. May you all be blessed with your vision for a better Asia."

PREAMBLE
The High Contracting Parties:

CONSCIOUS of the existing ties of history, geography and culture, which have bound their peoples together;

ANXIOUS to promote regional peace and stability through abiding respect for justice and the rule or law and enhancing regional resilience in their relations;

DESIRING to enhance peace, friendship and mutual cooperation on matters affecting Asia consistent with the spirit and principles of the Ten Principles adopted by the Asian-African Conference in Bandung on 25 April 1955, the Declaration of the Association of Asian Nations signed in Bangkok on 8 August 1967, the Declaration signed in Kuala Lumpur on 27 November 1971, and the spirit of the Hanoi Summit of 1998;

CONVINCED that the settlement of differences or disputes between their countries should be regulated by rational, effective and sufficiently flexible procedures, avoiding negative attitudes which might endanger or hinder cooperation;

BELIEVING in the need for cooperation with all peace-loving nations, both within and outside Asia, in the furtherance of world peace, stability and harmony;

SOLEMNLY AGREE to enter into a Treaty of Amity and Cooperation as follows:

CHAPTER I
Purpose and Principles
Article 1
The purpose of this Treaty is to promote perpetual peace, everlasting amity and cooperation among their peoples which would contribute to their strength, solidarity and closer relationship;

Article 2
In their relations with one another, the High Contracting Parties shall be guided by the following fundamental principles :

Mutual respect for the independence, sovereignty, equality, territorial integrity and national identity of all nations;
The right of every State to lead its national existence free from external interference, subversion or coercion;
Non-interference in the internal affairs of one another;
Settlement of differences or disputes by peaceful means;
Renunciation of the threat or use of force;
Effective cooperation among themselves.

CHAPTER II
Amity
Article 3
In pursuance of the purpose of this Treaty the High Contracting Parties shall endeavor to develop and strengthen the traditional, cultural and historical ties of friendship, good neighbourliness and cooperation which bind them together and shall fulfill in good faith the obligations assumed under this Treaty. In order to promote closer understanding among them, the High Contracting Parties shall encourage and facilitate contact and intercourse among their peoples.

CHAPTER III
Cooperation
Article 4
The High Contracting Parties shall promote active cooperation in the economic, social, technical, scientific and administrative fields as well as in matters of common ideals and aspiration of international peace and stability in the region and all other matters of common interest.

Article 5
Pursuant to Article 4 the High Contracting Parties shall exert their maximum efforts multilaterally as well as bilaterally on the basis of equality, non-discrimination and mutual benefit.

Article 6
The High Contracting Parties shall collaborate for the acceleration of the economic growth in the region in order to strengthen the foundation for a prosperous and peaceful community of nations in Asia. To this end, they shall promote the greater utilization of their agriculture and industries, the expansion of their trade and the improvement of their economic infrastructure for the mutual benefit of their peoples. In this regard, they shall continue to explore all avenues for close and beneficial cooperation with other States as well as international and regional organizations outside the region.

Article 7
The High Contracting Parties, in order to achieve social justice and to raise the standards of living of the peoples of the region, shall intensify economic cooperation. For this purpose, they shall adopt appropriate regional strategies for economic development and mutual assistance.

Article 8
The High Contracting Parties shall strive to achieve the closest cooperation on the widest scale and shall seek to provide assistance to one another in the form of training and research facilities in the social, cultural, technical, scientific and administrative fields.

Article 9
The High Contracting Parties shall endeavor to foster cooperation in the furtherance of the cause of peace, harmony, and stability in the region. To this end, the High Contracting Parties shall maintain regular contacts and consultations with one another on international and regional matters with a view to coordinating their views, actions and policies.

Article 10
Each High Contracting Parties shall not in any manner of form participate in any activity which shall constitute a threat tg the political and economic stability, sovereignty, or territorial integrity of another High Contracting Party.

Article 11
The High Contracting Parties shall endeavor to strengthen their respective national resilience in their political, economic, sociocultural as well as security fields in conformity with their respective ideals and aspirations, free from external interference as well as internal subversive activities in order to preserve their respective national identities.

Article 12
The High Contracting Parties in their efforts to achieve regional prosperity and security, shall endeavor to cooperate in all fields for the promotion of regional resilience, based on the principles of self-confidence, self-reliance, mutual respect, cooperation of solidarity which will constitute the foundation for a strong and viable community of nations in Asia.

Article 13
The High Contracting Parties in their efforts to ensure inter-regional cooperation and development shall open a political office for the headquarters of the Association in Bangkok, Thailand and shall ascribe the special privileges and immunities of the Global Assembly International Resolution on Global Diplomacy to the persons assigned to the office.

CHAPTER IV
Pacific Settlement of Disputes
Article 14
The High Contracting Parties shall have the determination and good faith to prevent disputes from arising. In case disputes on matters directly affecting them should arise, especially disputes likely to disturb regional peace and harmony, they shall refrain from the threat or use of force and shall at all times settle such disputes among themselves through friendly negotiations.

Article 15
To settle disputes through regional processes, the High Contracting Parties shall constitute, as a continuing body, a High Council comprising a Representative at ministerial level from each of the High Contracting Parties to take cognizance of the existence of disputes or situations likely to disturb regional peace and harmony.

The Association shall for the settling of disputes,

However, this article shall apply to any of the States outside Asia which have acceded to the Treaty only in cases where that State is directly involved in the dispute to be settled through the regional processes.

Article 16
In the event no solution is reached through direct negotiations, the High Council shall take cognizance of the dispute or the situation and shall recommend to the parties in dispute appropriate means of settlement such as good offices, mediation, inquiry or conciliation. The High Council may however offer its good offices, or upon agreement of the parties in dispute, constitute itself into a committee of mediation, inquiry or conciliation. When deemed necessary, the High Council shall recommend appropriate measures for the prevention of a deterioration of the dispute or the situation.

Article 17
The foregoing provision of this Chapter shall not apply to a dispute unless all the parties to the dispute agree to their application to that dispute. However, this shall not preclude the other High Contracting Parties not party to the dispute from offering all possible assistance to settle the said dispute. Parties to the dispute should be well disposed towards such offers of assistance.

Article 18
Nothing in this Treaty shall preclude recourse to the modes of peaceful settlement. The High Contracting Parties which are parties to a dispute should be encouraged to take initiatives to solve it by friendly negotiations before resorting to the other procedures provided for in the Charter of the United Nations.

CHAPTER V
General Provision
Article 19
This Treaty shall be signed by the Socialist Republic of Vietnam, the Republic of Korea, and the Kingdom of Thailand. It shall be ratified in accordance with the constitutional procedures of each signatory State.

It shall be open for accession by other States in Asia and the Pacific.

States outside Original Members may also accede to this Treaty with the consent of all the Member States.

Original Members may with a formal letter of intent rejoin the Association under Article 18 with the approval of the presidency of the Association and shall note that such privileges are maintained for, namely, Brunei Darussalam, the Kingdom of Cambodia, the Republic of Indonesia, the Lao People's Democratic Republic, Malaysia, the Union of Myanmar, the Republic of the Philippines, the Republic of Singapore, the Kingdom of Thailand and the Socialist Republic of Vietnam

Article 20
This Treaty shall enter into force on the date of the deposit ofthe fifth instrument of ratification with the Governments of the signatory States which are designated Depositories of this Treaty and the instruments of ratification or accession.

Article 21
This Treaty is drawn up in the official languages of the High Contracting Parties, all of which are equally authoritative. There shall be an agreed common translation of the texts in the English language. Any divergent interpretation of the common text shall be settled by negotiation.

"So, I guess you can join as a third nation, but you need to understand that we are no military organizations. We can still request a military attaché at the political organization in Bangkok. I suggest we establish another organ in Bangkok. It will be a science headquarters as well. I understand that the event is sudden, but we still need to continue our meeting. We can't waste our time more. Does Vietnam accept Australia to be the third nation? As an ASEAN Plus member. Does Australia understand that we are a trade and economic organization? We are here for the development of our country. As an original ASEAN member, I don't want to lose another cooperation organ to collapse. If we all agree, we can start to edit the agreement that Korea left for us."

"I believe that Australia can be a member of ASEAN+ while Thailand and Vietnam will be members of ASEAN. That way there is not need for reaching to justify inclusion. Due to the way we wish for the new ASEAN+ model to work Australia would be able to fully cooperate and interact with the organs of ASEAN. However, I think we need to fully nail down what differences between ASEAN and ASEAN+ would be. As there probably should be as to avoid confusion. Perhaps ASEAN+ members being able to opt out of certain programs if they do not feel that it will benefit them? I would like to hear Australia's opinion on this."

"Well as I said, we could include Christmas Island and Cocos (Keeling) Islands with their Shire Councils as full members of ASEAN, with ASEAN laws and regulations applying in those two territories, bolstering your numbers up to 4 key members and then Australia can be an ASEAN+ member. I think that would be the key difference. Involvement vs. requirement. If ASEAN started passing laws and regulations for ASEAN members, it should not have to apply to ASEAN+ members who are simply there to discuss and debate ideas within the council and other ASEAN organs. Essentially observers."

"I think we should consider Christmas Island and Cocos as part of Australia. I believe their sovereign state are already Australia. If we consider it as a part of Australia itself. Those islands should be granted as ASEAN Plus members under a sovereign state of Australia. We should apply any law or agreement to the ASEAN member first before applying it to the ASEAN Plus member. The ASEAN Plus should focus on trade as it should be. There are 2 options. The first option, we make ASEAN Plus membership the same as ASEAN, and the Plus will use to indicate the membership nation outside of the South East Asia region. The second is that we separate the membership benefit from ASEAN and ASEAN Plus. The ASEAN member should be able to do anything and cooperate like normal. The ASEAN Plus member should be a focus on trade benefits. We have been discussed for too long, and we need to find a conclusion fast before anything happens again."

"ASEAN is a geopolitical and economic organization. We are here to promote intergovernmental cooperation. We here to improve economic, political, educational, and sociocultural. ASEAN Plus is a cooperation framework between ASEAN members and negotiating partners. ASEAN Plus in the current state is for trading. The only matter we have now is should we apply ASEAN law and agreement to ASEAN Plus members? I suggest Vietnam that there doesn't need to be a difference. ASEAN is a geopolitical organ, and if there will be any members from outside of the region, we need a way definition them. So, basically, ASEAN Plus will be our partners that include in the ASEAN, but don't apply to ASEAN law. The ASEAN Plus member will only apply to the law mentioned in the separate agreement between ASEAN members and the negotiating partner. We will need to establish a New ASEAN first before establishing an ASEAN Plus. Is there anything to question? It is my fault that I don't clarify well enough."

"I think that is a good way to distinguish them. We can get this down in writing and have it be our official stance. Other then that we will use the treaty that Korea submitted earlier in this conference. Despite how long this has gone on for we have made a good amount of progress, and discussed issues that needed to be discussed. It is required for an organization that we want to last."

"Now, shall I draft up a new treaty to include what we have discussed so far? Also, I can get a transcript for our friend from Australia so he knows what we have discussed so far. Though, speaking of ASEAN Plus... Korea was adamant about the inclusion of China. What say the both of you?"

"Give me a minute to revive my memory of what we have discussed so far." Surin Pitsuwan would take his time. He would close his eyes and try to memorize what had been discussed.

"We have talked about what the ASEAN is, which is not essential. We have agreed we will replace article 2 with the GA and its laws and charter, right? In the Treaty of Amity and Cooperation in Southeast Asia. If I remember correctly, we will have an Asian Free Trade Area or AFTA. The free trade area would apply within the jurisdiction of the Member States, their exclusive economic zones, maritime borders, territorial borders, etc. We will have a political organ in Bangkok, maybe a scientific headquarter too. I think that's all. When Egypt came in, I think we started to talk about foreign events."

"I don't think China is a suitable member right now. Despite that their country has just formed the government, we should wait a bit more to observe the situation."

"I do believe we settled on not using the GA as a frame work due to the underlying issues it has. But yes, other then that I believe that is everything. I think we take the treaty that South Korea gave us, the Treaty of Amity and Cooperation in [Southeast]Asia and we go with that for ratification. This is a treaty that even non-ASEAN nations can join as to promote our vision. This means we only need two things."

"Firstly we need to create a new ASEAN Declaration, or we re-ratify the original one with some minor changes. I think the original document as it stands is fine, but we should add the portions for the inclusion of the Political Organ. Then I think we should create an ASEAN charter. These two things are all we need now to formalize the creation of ASEAN. We are that close my friends."

"I believe you are right. I have an ASEAN Declaration in my briefcase. It is easier to use than the original one. We need to change something as well. Give me a moment." Surin Pitsuwan would open his brown briefcase. There are many documents inside, and some pens. He took 6 papers out from his briefcase. He would show it to everyone and says. "As you can see, these papers are an ASEAN Declaration. We need to make it known as the Hanoi declaration. We need to change the date. I think we all know about this requirement. As you can see in the first context of the document. Vietnam and I will be the only ones that represent in the new declaration. And I think that is all. Do we follow the United Nations Charter? We also need to establish organs. We can add the article sixth about the organs that we will establish. Did I miss something?"

BANGKOK, AGUSTUS 1967​


The Presidium Minister for Political Affairs/Minister for Foreign Affairs of Indonesia, the
Deputy Prime Minister of Malaysia, the Secretary of Foreign Affairs of the Philippines,
the Minister for Foreign Affairs of Singapore and the Minister of Foreign Affairs of
Thailand:


MINDFUL of the existence of mutual interest and common problems among countries
of South-East Asia and convinced of the need to strengthen further the existing bonds of
regional solidarity and cooperation;


DESIRING to establish a firm foundation for common action to promote regional
cooperation in South-East Asia in the spirit of equality and partnership and thereby
contribute towards peace, progress and prosperity in the region;


CONSCIOUS that in an increasingly interdependent world, the cherished ideals of peace,
freedom, social justice and economic well-being are best attained by fostering good
understanding good neighborliness and meaningful cooperation among the countries of
the region already bound together by ties of history and culture;


CONSIDERING that the countries of South-East Asia share a primary responsibility for
strengthening the economic and social stability of the region and ensuring their peaceful
and progressive national development, and that they are determined to ensure their
stability and security from external interference in any form or manifestation in order to
preserve their national identities in accordance with the ideals and aspirations of their
peoples;


AFFIRMING that all foreign bases are temporary and remain only with the expressed
concurrence of the countries concerned and are not intended to be used directly or
indirectly to subvert the national independence and freedom of States in the areas or
prejudice the orderly processes of their national development;

DO HEREBY DECLARE:
FIRST
, the establishment of an Association for Regional Cooperation among the countries of South-East Asia to be known as the Association of South-East Asian Nations (ASEAN).

SECOND, that the aims and purposes of the Association shall be:

1. To accelerate the economic growth, social progress and cultural development in the region through joint endeavors in the spirit of equality and partnership in order to strengthen the foundation for a prosperous and peaceful community of South-East Asian Nations;
2. To promote regional peace and stability through abiding respect for justice and the rule of law in the relationship among countries of the region and adherence to the principles of the United Nations Charter;
3. To promote active collaboration and mutual assistance on matters of common interest in the economic, social, cultural, technical, scientific and administrative fields;
4. To provide assistance to each other in the form of training and research facilities in the educational, professional, technical and administrative spheres;
5. To collaborate more effectively for the greater utilization of their agriculture and industries, the expansion of their trade, including the study of the problems of international commodity trade, the improvement of their transportation and communication facilities and the raising of the living standards of their peoples;
6. To promote South-East Asian studies;
7. To maintain close and beneficial cooperation with existing international and regional organizations with similar aims and purposes, and explore all avenues for even closer cooperation among themselves.

THIRD, that to carry out these aims and purposes, the following machinery shall be established:
(a) Annual Meeting of Foreign Ministers, which shall be by rotation and referred to as ASEAN Ministerial Meeting Special Meetings of Foreign Ministers may be convened as required.
(b) A Standing Committee, under the chairmanship of the Foreign Minister of the host country or his representative and having as its members the accredited Ambassadors of the other member countries, to carry on the work of the Association in between Meetings of Foreign Ministers.
(c) Ad-Hoc Committees and Permanent Committees of specialist and officials on specific subjects.
(d) A National Secretariat in each member country to carry out the work of the Association on behalf of that country and to service the Annual or Special Meetings of Foreign Ministers, the Standing Committee and such other committees as may hereafter be established.

FOURTH, that the Association is open for participation to all States in the South-East Asian Region subscribing to the aforementioned aims, principles and purposes.

FIFTH, that the Association represent the collective will of the nations of Southeast Asia to bind themselves together in friendship and cooperation and, through joint efforts and sacrifices, secure for their peoples and for posterity the blessings of peace, freedom and prosperity.

DONE in Bangkok on the Eighth Day of August in the Year One Thousand Nine Hundred and Sixty-Seven.

"Hmm, in order for this to be truly recognized internationally we should look into getting a third party. But for the moment, aside from the party current present we will have to move forward. We should follow the old United Nations Charter until a time in which the GA Charter is more acceptable. Aside from that there is nothing else besides the organs that must be added. Did anyone bring a typewriter so that we may make this new proposed version of the Document?"
